Scam seller still has an account with items for sale, why is this?

I bought an item in January and never received it, filed a claim and was refunded. I look at their profile and they've done this to at least the 5 most recent buyers, maybe more who didn't leave feedback. Why doesn't Ebay restrict or close this account since it seems no one is going to get their stuff? They still have over 40 items listed for sale.

EBay doesn't use feedback in seller metrics. It uses cases opened. If every seller who doesn't receive their purchase opens a case it won't be long before the seller is sanctioned.

There are criteria that eBay uses to restrict a sellers listings or suspend a seller.

High INR rate

High NAD rate

High OOS rate

If the seller is a non US seller High BBE rate with bad feedback is also evaluated.

So if you see a seller that you feel is a bad seller and they still have some items listed, this is merely a guess, they are probably restricted from listing anymore and possibly on their way to becoming suspended or NARUd. 
eBay will never share the outcome of any reports you've made on a seller due to privacy policies.

This is very frustrating. I bought and paid for an item over 2 weeks ago. The seller has not shipped it an has not responded to messages. So I requested to cancel the item, they refused, but still have not shipped it.  I tried to contact Ebay, but the AI support only takes you in circles, there is not anyway to talk to an actual person. I finally had to dispute the payment with PayPal, so Ebay closed my item not recieved case. Now I'm waiting... How does the seller get to keep my money and never ship the item? I think Ebay has cut back on actual people in customer support? There needs to be some way to contact an actual person. Ebay, please add some actual people to your customer service team. I have had an account with Ebay for decades and really like being able to find most of the things that I want here. But if there is a scammer seller, how do you flag them if no one is driving the ship?  The AI autopilot isn't working.

You should have had an estimated delivery date in the shipping section, after you paid for the item. If you didnt receive the item a day or two after that date, you file an item not received case. If the seller does not respond, on the fourth day you ask Ebay to step in, you would have been immediately refunded. As was mentioned, the only way to put these scam sellers on Ebays radar is by filing a case against them. Contacting Ebay does no good whatsoever.There are over eighteen million sellers on Ebay, with two billion listings,so of course complaints are AI generated.

You could have bought it on Amazon, the same place the seller is buying their items from and you could have saved a little money.

You need to learn to use the Money Back Guarantee. First, sellers are never required to cancel orders. And it's never necessary to contact eBay when an item doesn't arrive. In fact, it's usually counterproductive. On the day after the last estimated delivery date you just go to the item in your purchase history and click 'I didn't receive it' under More actions. The process is fully automated. After three business days you go back to the case and ask eBay to step in. Then you get your refund.

 

The reason your case was closed is because you also opened a case with Paypal. To eliminate the chance someone will receive refunds from two places eBay automatically closes a case when a dispute is made elsewhere. Hopefully you'll get your refund from Paypal.

Looking at seller feedbacks why would you purchase from this seller in the first place?

It does take about 3+ months before eBay might interact...

Nothing is usually done overnight or in a month.

eBay uses an undisclosed system to decide on what and when action is taken.  Sort of  like

double secret probation.  Some sellers get banned in a very short time while others seem to get away with murder. eBay has never said how that system works.

When I bought it, they had like 30 positive feedbacks, so I thought maybe it was a new seller and bought the item.  Now they have several negative feedbacks for products not received. If that was there before, I would have selected another seller.

I did end up looking on Amazon and found one. I ordered it, that's all they had was the 1 in stock. I looked at another ebay seller with much more positive feedback and ordered a couple from them. They showed up in about a week.

I did file the item not received on Ebay and got the message to wait how ever many days. I guess I just got frustrated about not being able to contact a person. On the Contact us section of Ebay, they say we are here to help.  Maybe I should have just waited the extra week-ish?

I am a seller on Ebay and talked with one of my customers a couple of days ago who had a similar problem with the item not being shipped and couldn't get an ebay response, so he filed a complaint with PayPal. His problem is that he put items from several different sellers in his shopping cart, then paid for them all together. All but one of the sellers was legit and shipped the products. He told all of this to PayPal  and said it was only the one seller. But that did get translated over to Ebay and all of the sellers associated with that shopping cart got flagged. I was included in that shopping cart. My tracking# on Ebay shows his item was  delivered yesterday, so my part of it is good. I just have to wait for Ebay to sort it all out I guess?

Why couldnt the buyer get an Ebay response? Did he file an actual item not received case?

Your experience with seller is abominable.

 

Your pain and frustration are magnified by the fact that you have not familiarized yourself with the Ebay Money Back Guarantee and its automated procedures.

No human is required on the Ebay side. Your actions before you decided to contact Ebay were unnecessary as was your attempt to contact Ebay.

 

On many other sites, including Amazon, contact with a human being is difficult or impossible as well as unnecessary. This is an economic requirement of large interner marketplaces.

I just noticed that the negative feedback I left two weeks ago has been removed and his rating has increased over 4%. I think one other negative has also been removed.

Apparently something in your feedback violated eBay feedback rules. Did you mention opening a case? That's a violation, and savvy sellers will use it to get negative feedback removed.
