I just received a pair of sneakers that are supposed be new with box and they are very used. What do I do? I had a similar situation happen a couple years ago where the buyer said I had sold them a broken watch and eBay gave them a refund and let them keep it.
I think I to should be able to keep them but in this condition I don’t want them. What do I do?

Open a claim not as describe...seller gives and return label...and return them for a refund.

If you want a refund, return the shoes and use Not as Described as the reason.
The seller will have 3 days to accept the return and pay return shipping or refund without returning.
If they don't, return to the case on day 4 and ask Ebay to step in.

If ebay gave a refund and let them keep the broken watch, it's because you didn't handle the return request correctly.
Had you accepted the return, the buyer would have had to return it in order to get a refund.
You either declined or ignored the claim so when the buyer asked ebay to step in, they gave the buyer their money (from your funds) and assumed you didn't want it back so they let the buyer keep it.

Huh? You think you "should be able to keep them" but "in this condition I don’t want them?" That makes NO sense!
Why would you keep them if you don't want them in that condition? What you're asking for sure makes it sound like the sneakers aren't as bad as you're claiming if they're good enough to keep.
If you want a refund, go to the order, click "return this item" and when the seller sends a return shipping label, you send them back.
Once tracking shows that the seller received them, you'll get a refund. But you don't get to keep them plus get your money back.

167348907166 Is the item number and he responded saying he never listened them as new when it’s there in the listing for condition. I’m done with this jerk, I’ll just dispute the charge with my bank

Bear in mind if you escalate this to your payment provider, all ebay protections become null and void.
You needn't have any further communication with the seller. Just open an 'item doesn't match description' case as everyone has stated.

Do yourself a big favor and read the Ebay Money Back Guarantee for buyers. Your post and replies make it obvious you aren't familiar with them.

@gabrwer60 You're making it too complicated with this running to your payment source. Simply file item not as described. That's it. If the seller doesn't comply, you can have eBay step in. Chances are, they won't even make you trot to the post office to return the shoes since the seller seems uncooperative.
They're obviously used - they look clean, but the quarters are broken out, the toes are wrinkled and the seller didn't show the soles.

Listing says they are without box...
Now I do agree these shoes are very used as evidenced by this pic
