Received empty package - drop shipped from Amazon

I just received an item that looks like it was drop shipped using the sellers Amazon prime account - It came in one of those padded Amazon envelopes with just my name on it, no sellers address or anything. It also contained an Amazon Logistics tracking number ( TBAxxxxxxxxx)

The problem is that the enveloped seemed to be opened during transit, because its empty. Looking at the label, it does list some weight in it, so i doubt the seller tried to scam me - it looks like it was damaged under transit.  However the seller is still responsible - I didn't order from Amazon.

How do i proceed with making a claim? Seller didn't provide a tracking number and the guarantee delivery is today.

Do i open an Item Not Received case? I don't see Item not as described option in my listings.

Go to the Resolution Center and open a case for  ITEM NOT AS DESCRIBED.  Seller must accept return, and provide a return label if they want the empty package back.

Go to the Resolution center select the item and file a Not As Described dispute, I believe there is a sub option to select received an empty package.  ebays tracking system will not work with Amazons. PBA tracking system which only gives delivery date info.

The seller has to accept the return even if it is for the empty envelope, which you should send back so they can deal with it) then they will have to deal with Amazon  over the empty package issue. Chances are the envelope came open in the delivery truck.

I did that, it appears to have created a return request. 

There is a label for me to print, i guess i'll have to mail the envelope back to the seller.

It says seller has 3 days to respond tho, should i wait before I send it?

Seller could be one who uses FBA - Fullfillment By Amazon - to ship their orders. 

And they did "respond" to your request by sending out the label, you should go ahead and use it.  You'll get a refund as soon as the seller receives the empty envelope.
