I received pasta and a camera instead of a Nintendo. The case was closed, and I can't get my money back. I really got scammed!

What kind of case did you open? The correct case would have been a return for an item not as described.

Did you file an ITEM NOT AS DESCRIBED CASE? Most likely you chose the wrong return type since it was closed.

I opened a not received first because the seller was not going to ship the item. weeks after he shipped it, and this is what I got.

I dont know what to do anymore. eBay is not helping me. This was a $400 purchase. I'll do everything to get my money back.

You lost the case because you received something. Now you have to try to file a case for item "Not as described."
IIRC it's possible to file a "not as described" case even if you had opened a "not received" case. But if you can't, then you would need to seek recourse through your payment processor, such as PayPal or your credit card company.

That's why you lost. When you file an INR case, they rely on tracking. Since tracking shows it was delivered, the case was closed.
As myself and other have stated, you need to file an item not as described.

Yes, I know the case reason is misleading because he was not going to ship it first. I filed it but then he shipped the item and got the wrong item.

I also used PayPal to file. They just closed it. I don't know what to do anymore.

What kind of case did you file with Paypal? If it was an INR, that's why they closed it.
And that's what happened with your eBay case too.
Last possible option: Do a charge back on your credit card.
And may I suggest re-reading eBay's Money Back Guarantee for buyers so that you will know what kind of case works best with which situation?
Just curious: Exactly how did you know he wasn't going to ship it first?

I can't file a case anymore. I think I'll just send this to ic3.gov since I have all his info. Hopefully, the cops will raid him.

Which type of case did you file with PayPal -- "not received" or "not as described"?
If you used a credit card when making your PayPal payment, then you can try going through them.
You also need to read eBay's user agreement about buyer protection. They call it the "Money back guarantee" because if you follow its procedures you can get your money back.
If you ever find yourself in a difficult transaction again, please come here for advice before you do anything.

This response and some of your other responses show, no offense, a bit of immaturity.
Instead of guessing, etc. how's about you read up about the MBG and what to do in these types of situations instead of assuming and making the wrong choices?
