Hi, I ordered several items from a seller and the package was missing one of the items when it arrived. I contacted them and they said they will refund me for it, but they only refunded half the cost of the item and not including tax either. They didn't "cancel" the ebay transaction for that one item, seems like they just did some kind of partial refund amount from the total and the item still shows as purchased.
If I open an INR, will the seller win the case since they can provide the tracking number that shows delivered (since all the other items were sent in one package)? Or since it shows they provided a partial refund. What's the best next step I should do to get the remaining money back for the missing item?

On eBay you need to open a not as described request.

eBay says here "For example, you buy three books that the seller listed individually, but you paid for all of them at once at checkout. You can return each book individually."
So you would click Return this item or More actions > Return this item to the right of the item that still shows as purchased here with the reason Missing parts or pieces since the entire item was not in the package.
eBay will prorate the shipping and sales tax for that one item cost out of the combined total payment, less the partial refund already issued: You will immediately see the expected refund on your return request page.
From this point, ignore your seller and do not respond; just wait for your refund. If your seller foolishly decides to pay for a return label, instead of just paying the expected refund, you would either affix the label to the empty package or to an envelope, both with the return label's packing slip enclosed.
If the seller does neither, ask eBay to step in after 3 business days. You'll get the refund when the return label is delivered to the seller, or eBay may force a refund outright, no return needed.
