Non returnable item trouble.

Hi. I bought something by mistake but the seller refused to cancel the order.  They took days to respond.  They don't take returns.  When I received the item I contacted and agent here on ebay to ask what I should do.  Agent suggests return request which I did.  But seller messaged me back saying they reported me to ebay and threatened to sue me in court if I scammed them.  I would never scam someone. I have decided not to proceed with the return after the request closed.

Report the seller for what?  The seller hasn’t done anything wrong.  Seriously, I would like to know what you were thinking of reporting them for.

All you did here was to repeat your original post.  I’m still not clear what you think the seller did wrong, that would be worth reporting them for.

The seller is not required to cancel.  They are allowed to ignore a request for a cancellation.  You received bad advice from the agent.  The seller didn’t have anything to do with you receiving bad advice.  Sellers have such limited protection from problems that it’s easy for a seller to think there is a possibility of a scam.  Sellers are very proactively overprotective of their accounts.

 

After the request closed,, you can’t proceed with a return anyway.  Once an eBay case is closed, no matter how/why it closed, it’s not possible to reopen it.

All you can do is ask the seller to cancel an order, but they are not required to.

If they have a no return policy, they can deny a remorse return.

Sellers can have No Returns policies.

Sellers cannot have No Refunds policies.

 

Did you pay for the item?
If not the transaction will be cancelled after four days and you will get a Strike.

 

Did the seller ship the item?
If they did when it arrives open a Not As Described claim.

You don't have to open the package but do NOT refuse it.

The seller will be required to send you Return Shipping and refund you on arrival.

 

Has the 30 days from delivery Money Back Guarantee passed?
If so, you are still covered by the chargeback provisions of the card you actually paid with.

 

But.

Pay attention in future when you want to buy something.

Give it a hour or two's consideration.

The basic problem was your "mistake" although the seller was stupid not to agree and cancel immediately.

Why are you suggesting the OP fraudulently open an item not as described case or do a credit card chargeback when the only issue is that they ordered the item by mistake? Why should the seller be penalized for the buyer's mistake??

You let the seller scare you into not going through with your return.

What the ebay agent failed to suggest to you, if you have bought an item by mistake and the seller does not accept remorse returns, is simply sell it yourself.

It's not the seller's fault you purchased the wrong item.  Why do you expect them to foot the cost of that?  You can always resell it yourself on eBay if you don't want it.

If you buy something on eBay and decide you bought it by mistake, changed your mind, found it cheaper elsewhere, it doesn't fit, or you just don't want it, that is called a remorse.  Sellers are not required to accept returns on remorse buys.    

 

I hope the item was not an expensive one.  You said you are not going to proceed with the return and that is the right thing for you to do.  The seller did nothing wrong. 

 

Respectfully, the next time you decide to buy something, think about it for a while before hitting the commit button.

What was item cost that was worth it to sue you in court? Highly doubt it was high value to go through all the motions. You let the seller scare tactics take over, and allowed the case to close. This is on you. Take this as a lesson.
