Money stolen by seller

After ten years with perfect feedback, I bought an item, it was not as described so I returned it per sellers policy. Ebay tracking label shows returned. Seller refused to refund. I filed a claim with both eBay and Paypal. Ebay claims despite being valid they immediately close valid claims of filed with PayPal. Paypal claims even though Usps tracking shows return delivered to seller and my years of perfect record they denied. Each side passes the buck. I stupidly trusted both eBay and Paypal and did not use a credit card. Never again. Other then just dumping Ebay for a competing sales site how do I get my money back. Won’t jet me change feedback to negative, too small an amount for small claims court. Neither Ebay or Paypal answer phone.

I appreciate everyone’s well wishes and support. I’m happy to say that Paypal did the right thing and refunded my money. I now know that I should appeal with eBay first. I also know that it’s a waste of time posting on eBay forums because bootlicking toadies always blame the victims . I forgive you and I accept your apologies. Good luck.

After ten years on eBay, and being a seller yourself, I would think you'd know how this goes.

1. Never return an item to a seller without filing a return request through eBay.
2. Never open cases with both eBay and PayPal at the same time.
3. Never leave feedback until the transaction is complete.

Did you open a return request and were you sent a return shipping label by the seller, or did you buy your own return postage?  If you did pay the return shipping cost did you upload the return tracking to the return request dispute? A seller has 6 days after a tracking number shows delivery to issue a refund.

You can only file one claim at a time first with ebay, then if you lose the dispute you can try filing with PayPal.  By filing two disputes at once it was seen as double dipping so the ebay dispute was closed. It is possible PayPal closed the dispute filed with them for the same reason.  You may be able to appeal the PayPal dispute however.  (link below)

Because you opened two disputes at once you may not get your money back.  Buyers have never been able to have a feedback revised from positive to negative.  However, you can leave a follow up comment to the positve you left. Go to the bottom of your feedback page and you will see a Follow Up to feedback given button.  Word the comment carefully or it could get removed. Something like, "Didn't work and was returned w/ tracking, seller has not refunded" .

I know PayPal's call center is understaffed because of the covid-19 virus. There is a message to that effect on thier page.  I'm guessing eBay's call center probably has the same problem.

 

None of this would have happened had you followed the terms of eBay's Money Back Guarantee policy and gone through their process, Before opening a Paypal dispute.  Since you say the amount was small you may have to look at the loss as a lesson learned.

Yep I used Ebay’s return label and tracking shows it was received. The refund should be automatic once received. No where is it explained rationally why I can use PayPal disputes and if it fails not use Ebay’s. They hide behind the lie of being different companies but collude and conspire to deny claims. If it were double dipping only one refund would occur

The moral is to never use PayPal balance to buy. As my case shows neither Paypal or Ebay will stand behind buyers in a dispute. A credit card company will. Paypal has decided users into thinking they are similar to a credit card company or bank. In fact they are far worse in disputes. And card cos answer the phone.

Unless users read literally hundreds of pages of instructions , every little nuance of policy isn’t explained in detail. Ebays business model is impulse buying by quickly clicking an icon. It’s not deliberate. The model requires no one carefully considers and deliberates before buying. Buried multiple pages deep is a statement that customers are forbidden from availing themselves of all methods to protect themselves which is why purchases default to Paypal balance or checking account or debit card. On a mobile device the interface is so dumbed down that finding policies is neither clear or transparent. And reaching anyone on the phone has long been actively discouraged. We just get emailed cut and paste form letters.

The terms of refunding is covered in the Money Back Guarantee policy, if a seller does not refund within 6 days ebay can be asked to step in, a refund will be provided and they'll then deal with the seller.

You can open a PayPal dispute first if you like. However, when returning an item that is not as described PayPal requires the buyer to pay the return shipping cost.  Therefore, and eBay dispute should be opened first.

Since the companies are two separate entities they each have their own policies. If you open two disputes at the same time, yes only one refund will happen, but one dispute will be closed.  Since much of  getting a refund is handled automatically when each company's computers detect a second dispute, they may both cancel the dispute.

The real moral is to read and follow the return policies of any company you buy from or use pay with online, so you are aware of how returns/refunds are handled.  Since ebay's policy has a shorter time frame, using their policy first is common sense. PayPal offering a 180 day policy, though the buyer pays the return cost should be second.  

A second moral, is not to leave feedback until an item has been inspected or used, and the seller contacted... before leaving feedback.

 

If you use a credit card and file with both PayPal and the card provider, you will end up in the same position. One or both claims will be denied.   Additionally, since Paypal acts as the payment agency for accepting the card payment, their buyer protection is the one to use first,  A card provider is the last avenue that should be used.

 

I just finished up a not as described MBG dispute where the payment was funded with my PayPal balance.  The seller did try to deny the claim, but ebay decided in my favor.  The seller did not refund within the 6 days they had, after tracking showed delivery, so ebay authorized the refund which went back in my PP  balance and they will go after the seller.  Because the seller was a jerk, I'm going to keep them wondering when the feedback axe will fall.

If you've ever called a customer service line, you have been placed on long holds, and you have overheard other operators talking to customers in the background.  Over the last month I'm willing to bet that because of the virus and distancing, many call centers have cut down on the number's of operators in a room at any one time.  Many are using the call back option, so customers do not have to hang on the line for god knows how long.

eBay does provide these boards as a way for people to get help, as well as forums on social media sites.  You also can use your mobile device like a computer instead of using apps.  You can do online searches to get a company's policies on your phone instead of trying to go through a company's site map when connected using an app which usually are set up to give abbreviated information.

If you mean a phone, why anyone would use that to shop or sell with a tiny 5 inch screen is beyond me. Use a desktop or at least a laptop and mouse if you want to navigate on Ebay efficiently.

because for the vast majority of internet users, the default browsing device is a smart phone, second a tablet, next a laptop or deskop. Thats the way of the present. Maybe its an age thing?

There is no requirement to read the hundreds of pages of policies and terms and conditions before opening an account. I very rarely return anything so am not intimately familiar with the irrational policy that even though the ebay refund was initially approved, because I legitimately talked to the people who had the money, Paypal, Ebay would then close and not re open their previously approved claim. And not of this was explained.

The OP is incorrect anyway. The vast majority of people who access the internet use a combination of both mobile and desktop platforms. S/he's just yanking your chain, as they say.

In iphone at least, you can make the text size and other items as large as you want. Should the the same on Android too. Also in ipad and iphone every browser defaults to the mobile neutered view, unless you use Chrome and select "view desktop site". Every browser is like that. In addition most sites almost force the use of the app over the mobile site.

Note to moderator: What are you and ebay hiding that you don't want transparent discussion? Does Ebay have any interest in keeping me as a member after ten years of 100% perfect feedback buying and selling? If not I am cancelling my account. At this point no one will communicate other then to censor my honest messages. I want to have someone contact me by phone.

So you can see 8 or 10 characters at a time and have to scroll right every 2 words? No wonder I get cancellations when some idiot buys my item, wonders a week later why they haven't got it, and THEN reads the listing to find out it's local pickup.
