Lost my case - item not received - this is what you should do, learn from my experience.

I had gone through a lot in the last two weeks trying to get my money back from a tracking scam on eBay. 

Here is what I learned and also suggestions for whoever encountered similar situation (tracking says delivered but item not received). Hope this is helpful.

1. If the tracking says your package is delivered but you do not receive the package. Go to the carrier(USPS, Fedex, UPS etc..) and ask them where the package is dropped off. They should be able to find out if the package is delivered to your address or not. If the package is delivered to different address, ask them for a tracking report or a document to clarify the package is not for your address. I obtained the tracking report from USPS office manager.

2. Send a message to seller to let him know what you find and ask the seller to respond. eBay will ask you to do so later anyway. If seller does not respond or try to work it out, you can let eBay know. At the same time, go to eBay under your order to file a case to report "item not received" and provide the tracking report or any evidence;

3. It is possible that eBay will close the case in seller's favor if the delivery zip code matches your shipping zip code. 

4. Important! Go to https://www.facebook.com/eBayForBusiness to send a message to eBay customer support. Make sure to explain your case to include seller name, product number, order number, tracking number and evidence you have. It will take a while before a real person responds. So please be patient here. The customer service should be able to take care of your case if you provide enough information.

5. If step 4 does not work out. Go to your PayPal or your bank whoever you use to make the payment. Don't do 4 and 5 at the same time. Once you do 5, eBay cannot use Money Back Guarantee procedure anymore. So only go to 5 if 4 does not work for sure. I filed a dispute with PayPal before contacting eBay on Facebook which was a mistake.

6. For my case, PayPal automatically closed my case in seller's favor because he provided the tracking number to show a package delivered to my zip code. Right away I dispute this result for a second time. At the same time I went to PayPal help center and "contact us" and sent a message to request an agent instead of auto assistance. It took a few hours before a real person replied my message. But finally somebody actually responded and was able to manually review my case and go through the evidence provided. A few minutes later, she closed my case in my favor and refunded me right away.

My money is back. It is a long way. I want to share my experience with you and hopefully help you if you are ever in similar situation.

It sounds like PayPal refunded you out-of-pocket, unfortunately. So because you didn't get eBay on Facebook to force a refund from the seller using your evidence obtained from USPS

 

You got -- a courtesy refund.

Your seller got -- away.

I don't think PayPal paid me from their pocket. I filed dispute to on-hold the money the first time before eBay closed my case and right away the second time after first failure so the money was on hold the whole time. Then I went to get customer support to get them review manually and have the result overturned.

I am also a seller using PayPal to receive money. If customer files a dispute PayPal can withdraw the money from my account and keep it on hold even the order is closed for months. If the buyer wins the case, the money will be taken from seller account.

You must be a seller at 'another' venue to be using Paypal- as Paypal is NOT where sellers $$ goes anymore.

1. When you started an INR refund request, the money was put on hold.

2. When you went to PayPal, eBay aborted your case, and released it back to the seller.

3. Immediately, PayPal put a hold on your payment to eBay Commerce Inc (the seller name at PayPal).

4. Following, PayPal made its final decision in favor of eBay Commerce Inc in your INR dispute.

5. When you appealed, PayPal saw its decision was flawed, and paid for its mistake.


If you had gone to eBay on Facebook, the seller is forced to refund (eBay-speak "require a refund"), because the case is within eBay.

If you had gone to your card issuer, it's a brand new chargeback (no previous chargeback had be incorrectly decided) so the card issuer reverses your payment to PayPal, PayPal retakes the payment from the eBay Commerce Inc account, then eBay debits the seller's payout.

I have my money back. That is what I care about. If the seller got away with the Money and eBay or PayPal has to pay from their pocket. I don't feel bad for them. I did what I could to provide evidence to prove it was a scam. Both eBay and PayPal used bot to determine to favor the seller without reviewing the evidence or reading my explanation.

There is no a clear instructions on eBay how to proceed. When I opened the case and submitted evidence as requested, ironically no a person to review that (why do they ask for evidence to attach anyway?) Thankful I got suggestions here to go to Facebook to get a real person to respond which also reminded me to try to get a real person from PayPal side to review my case. The whole process was very frustrated and stressful. I have done nothing wrong and I don't deserve this.

#2 If your information shows:  The label was printed before you bought the item. Was sent to a different address in your zip code.  Package was not appropriate type/size/weight for what you bought. There is no sense in contacting the seller. Proceed straight to filing a dispute. 

 

#3 The first item not received dispute is checked by a computer which can only check the tracking info for a Delivered scan.  So the first dispute will be found in the seller's favor.  

  There will be an appeal button in the dispute, that is on your My eBay Summary page.  You can add a scan or clear photo of your written information to the appeal which will be looked at by a real person, and the original decision overturned.  That should be done before taking step #4

 

#4  If you go to Facebook and enter the scan/photo of your information. You should win if the info you got from the shipper is a signed note on their stationary.  eBay will not accept emails, or tracking number printouts, since they can be faked.

 

#5  If you have to go to PayPal and give them the same info that did not work for ebay's Facebook reps, It is doubtful you would win using PayPal, or your card provider, because you did not provide enough PROOF the first three times.

 

The fake tracking scam is so popular,  because scammers know what has to be done to get around ebay's and other 3rd party online shopping site's  protections. They also know that most people do not:

A)   Read the terms of the various shopping site's  protections. 

B)   Give up to easily if the first claim is refused.

Unfortunately I screwed up due to a combination of errors. Completely my fault and I shouldn't have lost my head.
