Is this eBay fraud and how do I get help?

I've been using eBay since 2005. I recently purchased an item on eBay. The seller sent it with FedEx using a shipping method that required signature upon reception.

 

On the day that eBay listed my item as "Delivered", I had not received the item.

Upon investigation, someone received the item and signed upon reception "Mr. person's name". That is not my name, that is someone else's name. I do not know who this person who received and signed for my item is and where they live.

 

I couldn't do anything on the FedEx website to open a claim because I would need the sender's address, which I do not have.

 

I opened a claim with eBay, and they said "Your item was marked as delivered so you will not get a refund", even though I had included a screenshot of the Fedex tracking page with signed upon reception by "Mr. person's name" visible.

 

Obviously I am furious at both the seller, the person who signed for it and didn't reach out to me to return my package, at FedEx, and at eBay for mishandling this.

 

The seller could have just send a postcard to a friend with signature upon delivery, and pocketed my money. Was I victim of a fraud? I am at loss for solutions here.

You need a statement from FedEx that the pkg was not delivered to your address, tho they wont tell you where it was delivered. Submit that to Ebay. If that doesnt help, and you paid by cc, try for a chargeback.

Thank you for your help. 
I just spend 20 minutes on the phone with FedEx and the representative I talked to confirmed that the sender didn't add the apartment number on the label. 
They are supposed to call me back with GPS info of where the parcel was delivered and 
ask the driver where they delivered it.
Maybe that will help.

Contact the Attorney General's office of your particular State.

eBay charged me 18% sales tax (when it should have been 11%) on an in California eBay purchase I made.

eBay claimed (when I contacted them via phone) that the State collects the tax, not eBay.

Now there's a load of horse **bleep**.  eBay acts as an AGENT for the California State Board of Equalization and collects the sales tax directly for and on behalf of the State.

The Attorney General of California likes to hear about eBay Sales Tax Abuse!

The OP does not have a problem with sales tax.

The problem is a bad address leading to a mis-delivered package.

 

@beforedecay 

Check your own PP or eBay account to confirm that your apartment number shows on your address on BOTH sites.

Unfortunately, if the address you give is Undeliverable (for example if the apartment number is wrong) eBay does not insist that the seller refund the payment.

 

Also, if you are in the same building and you can see the signature, why not call on your neighbour and ask for your parcel?

Thank you. Yes I have no problem with sales tax.

The address is correct (as indicated I am using ebay since 2004... and duly edit my info each time I move). 

 

FedEx confirmed to me today that the seller sent to the wrong address.

I do not know who the person who signed is, none of the neighbours I know are called that, even though I do not know the name of all of my neighbours and cannot look them up in the white pages...

It's not your item. More than just another person's address @beforedecay it was that person's package, which they ordered for themselves, and it arrived.

If it was shipped a few days before your purchase

If it weighs very much more than your item

If the box is too small for your item

then the tracking number that your seller provided already shows all by itself that it's not your item. Your seller just copied that tracking number, and gave it to eBay.

Get a letter from FedEx stating that and use the letter to appeal the case.
