I have had a seller insult me and refuse to sell me an item for no reason. Just randomly wakes up today and chose to sell me an item, ruined my bday and entire weekend and eBay doesnt even do anything at all.

You simply didn't get the item that you wanted.

I’m thinking it’s as the op said it’s one of a kind and they likely can’t find it anywhere else. The seller can’t be forced to sell but I think The ops arbitration is to get the value of what the item is vs what they paid. For example buyer purchases item worth $200 but seller and buyer agree in a contract to purchase at $100. If the seller doesn’t follow through on the deal the buyer may decide to sue for the difference in the price they paid and the value of the item in the example $100.

Not if the seller used the out of stock or damaged reason...cant get blood from a turnip, if the item is no longer available.

It amazing that on eBay someone can break these contracts w/o even verification from eBay that they have a proper legal reason to break the law.
Thank you for providing details here. Generally, what we see is that the buyer instigated the adverse situation by offering an offensively low price, or asking inappropriate questions or making unreasonable demands, threatening, etc.
So while the buyer is irate and states this happened for no reason, the reasons generally become very apparent.
In your case, that doesn't seem to be the case. You don't post feedback before you receive the item. I don't know why they feel there was suspicion of fraud. Perhaps just the reason they told you to chose to end the transaction as I don't think that is a valid reason when they process. I don't know what no fees back, new account means. Did you create an account to buy this? Maybe that is true. Possibly the someone else paid more for the item than you did?
As for investigating, Ebay has a privacy policy so no one knows what is going on with anyone else's account.
As far as breaking contracts, yes, this seller did that. But buyers break contracts all the time through bid retractions and transaction cancellations. Ebay can no more force a buyer to pay than they can force a seller to sell and ship.
I'm sorry you have been so disappointed here, I have been in your shoed and it is upsetting, but there isn't anything you can do about it. And you may have dodged a bullet~what with asking for feedback before you received the item.

That's a good point but I think this is where the scenario will break down. If the item is one of a kind as the OP states, OP won't be able to prove what the item is worth, ao I don't know that they will be able to award anything other than what the OP paid for this item. Of course if the new buyer paid more than the OP, that would establish the going rate and perhaps that difference might be awarded to the buyer from the seller~

But again, it comes down to, they can't force either party to complete their obligations, but each receives penalties against their account that may cost them their buying or selling privileges.

They can’t get the item if it’s gone but they can try to get the value they lost in the deal
its not about trying to get the item but trying to get The value so another can be bought

I am even more confused now. How did you find out that they sold the item to someone else? Did they message this to you or what?

I'm sorry you weren't able to get the item you wanted. It's hard to understand why the seller acted this way, but it's good that you didn't leave positive feedback without having received the item. Don't give up on eBay. There are better sellers out there.

OK... First off, there is no such thing as "for no reason" There are only right or wrong reasons. Second, you parlay cryptic information...You [basically] tell us nothing... And thirdly, if your are able to diserne you've even HAD a nother birthday...It's a good one.

Yes they sent this is a message during exchange after the cancelled order for no reason. The entire exchange was insane to be honest.
