I have had a seller insult me and refuse to sell me an item for no reason. Just randomly wakes up today and chose to sell me an item, ruined my bday and entire weekend and eBay doesnt even do anything at all.

I'm sorry if the seller insulted you. Sellers are here to sell, they don't refuse to sell lightly. Your post is confusing because first you say she refused to sell you the item, and then you say she chose to sell you the item.
May I ask what transpired before this happened? Just asking because a seller does not just insult someone and refuse to sell to them out of the blue there would be an action on the potential buyer's part before that happened.
I'm sorry your birthday and weekend were ruined. Happy Birthday, though.

You post is a bit lacking in detail, OP. Since the ID that you posted under doesn't appear to be very active in regard to buying or selling I can see no obvious reason such as excessive bad feedback left for others or too many bid retractions. Could it be that your attempt to make a purchase was made on a different account?
I'm afraid that without more details about the particular attempt on your part to buy it is not possible to advise you. Of course, the seller probably had what in their mind was a good reason to choose not to do business with you. That is their right. As far as insulting you, we weren't privy to the conversation so again there is little we can say on the matter.
Just out of curiosity, was your attempt to purchase something from this seller made by making an offer?
While I'm sure that not being able to buy something that you wanted is frustrating, especially on one's birthday, don't you think that letting it ruin your birthday and entire weekend a bit of an exaggeration? If not, perhaps you are a bit too sensitive for eBay.

Your post is rather lacking in details and the ones you did post are contradictory.
If you are really that sensitive, Ebay just might not be the right place for you.

I did nothing man. Person eached out first and basically tried to get me to leave them positive feedback before I even reeived item . Four days after I had paid for the item, on roughly the day I should have been received shipping information. I log-in to see my ordered cancelled with a rude message. Basically just woke up and decided I wasnt "good enough" to be sold the item due to some made up reasons. they literally said:
"We canceled your order due to suspension to fraud
No fees back new account? Sorry we can’t trust you with a grail
Have a good weekend
Your feedback will process in 2-3 Bussiness days"
Then proceeded to sell my one of a kind item to someone else. Even thought these buy/sell contracts are legally binding. I dont understand why this person did this or why they would rather pay 3 times the value in arbitration instead of just keeping their word. This has made me very hesitant about eBay in general after seeing the lack of proper processes or responses to people breaking the law and breaking contracts. Doesnt seem to matter much at eBay, you can even see if they are looking into a situation r get any documentation steps are even being taken. Even Amazon or any other seller would clearly let you track and see issues tht need to be resolved. It amazing that on eBay someone can break these contracts w/o even verification from eBay that they have a proper legal reason to break the law.

Chinese seller? Even if the seller cancelled your transaction, you can still leave him appropriate feedback by going to the Feedback Forum. If he cancels too many times, he will be suspended.

No. American, yeah its ridiculous I have to wait 7 days to leave a negative review but if I wanted toleave positive I can right now. I am beginning arbitration against them through eBay, eBay basically forwarded me all the information to submit a case. This person is going to end up paying 3 times the item plus the arbitration costs, I honoestly would still rather have the item than even the increased payout. The item is one of a kind and basically priceless. I fail to see how eBay positions the contracts as legally binding then does exactly zero to handle them.

Then hes a power seller, and has that privilage of the buyer having to wait seven days to leave a negative feedback. why would it cost the seller three times the amount of the item for arbitration? Its not worth the paper its written on,if the seller used the out of stock, or damaged item option. You cant force the seller to send the item to you, neither can Ebay.

I am not sure but you might be wasting your time filing a case. Sellers cannot be forced to sell. Unless E-bay would physically send an employee to the seller's home, rip the item out of their hands and mail it to you, the choice to complete a sale is entirely up to the seller.
They will, most likely, receive a 'defect' from E-bay for not completing the sale but maybe not. Too many defects and they will lose their selling priviledges here.
Buyers are not forced to pay when they enter into this 'binding contract' so sellers shouldn't be forced to complete a sale if they find something in the transaction that raises a red flag under the same 'binding contract.'

As the plaintiff, concentrate on your case preparation, to insure a favorable arbitration finding.
