Lo and behold I get it today in a PRIME envelope with the 'gift' receipt inside. I am tempted to give the seller a neutral. I am sick of the deception.

So when you say that when you go to eBay you want the product from eBay, that doesn't make any sense to me. You will never get a product from eBay - not even eBay shipping or souvenir products. Everything is sourced elsewhere.
Yes, literally it won't come from Ebay. What is meant here is actually from an ebay seller. The buyer made the choice to buy it from an Ebay seller as opposed to Amazon. Buyer bought it ON ebay as opposed to ON Amazon, but found out later it really didn't matter.

Then it's strange that I had to sign I would not do so in my Prime agreement, as it stated it would be considered misuse of my free shipping, allowed only for Personal use, and gifts to family & friends (and my buyers are not my friends; just pushing that out of the way before someone gets creative).
Perhaps you are okay with your Prime $ being spent this way; I am not. Monthly charge just went up $3. Of course, if it wasn't in the contract, that would be different.
I realize there are sellers doing this presently, and they may come up with a multitude of reasons why it is just fine (I am NOT saying it is anyone here in this thread; obviously I don't know how or why you disagree). I'm just saying that it is not as simple as "you got your item and so should be happy". Such as: returns can be problematic. And cancellations for out-of-stock can also occur.
I also would not leave a negative feedback. Possibly a neutral, but most likely not unless I had a way to know for sure it was not a fulfillment account member (which I did bring up the possibility in my 1st comment). As Dog said, I would report it to Amazon, and let them sort it out.

I am not a Prime member, my orders from Amazon arrive in Prime packaging, and a gift receipt is an available option at checkout for anyone not just Prime members.
Oh yeah, I've never paid for shipping on Amazon so no reason (for me) to drop one penny on Prime.

Did the OP's seller offer free shipping or charge for it? Not sure if it's a fair question or just a red herring on my part but I ask because you mentioned the seller pocketing shipping.
The Prime account is for personal use and they get free shipping. BUT it was never intended by Amazon to be used for a seller to dropship for their business.
No, that isn't a valid parrallel because you are negating the basic premise. Amazon themselves state that the Prime account is not for dropshipping. Period. It is abuse of the program.
Seller that do this charge the buyer shipping. That's why they do it. They make a profit on the item and on the shipping.

No, because it is expressly forbidden to use it that way. Also, It has been in the news (just recently) that the way several people got caught doing this is because the River (particularly Prime) noticed that there were just too many 'gifts' going to too many addresses through this couple (A is suing them). I believe in the article A stated they will be monitoring those with a high volume of outgoing Prime ship-to addresses. I wish I could remember the news source, but I read a huge amount of news online, so can't recall now. Will add later if I find it.

As I stated in my message #12, items shipped via an FBA account may include a "gift receipt." So, the fact that there was a gift notice does not prove the item was sent with a personal Prime account. All the seller has to do, when processing the eBay sale, is mark that it is a gift.

That may be dishonest, and may be against Amazon rules, but it is not "deception".
Dropshipping is a common practice here.
