I won an auction and I messaged the seller multiple times asking for a shipping update. They finally responded claiming the item they listed “was a fake” and they they wouldn’t feel right shipping it.
When I go to open a request through the app, the page says “your item may still be on its way..estimated deliver date is 11/21..if you still haven’t received your item go back to the item you purchased and open a request.”
The seller told me they’re not sending me the item so I know it’s not “on the way”. My money is stuck with this seller and I have no pathway to resolve. What do I do!

Look on the listing for the last estimated delivery date. If it was 11/21 you can open a case on 11/22. Go to the item in your purchase history and select 'I didn't receive it' to do that.

You can open INR tomorrow (Tuesday).

Don't exactly understand your "no pathway" statement.
Per the MBG, once the item is 24 hours overdue, you, the buyer, can start an item not received case. You have 30 days past the estimated delivery date to do that with eBay
