E-Bay allows sellers to rip you off

Bought two hats from a seller. Seller sends a tracking number. Item arrives but is only half the order. Seller claims another tracking number and states it was delivered. It was not, Contact E-Bay and to no help, they allow seller to change tracking info so it shows bogus tracking number now. E-Bay allowed the seller to change the information during in active complaint. No refund, no hat, no help from E-Bay customer service, It is all about the money and not helping the customer.

Were these two separate listings or two hats in one listing?

If they were two separate listings with two separate item numbers, open an item not received case for the one you did not receive.

If they were two items in one listing, then what you have is an item not as described case, so you can open an NAD case.

Or was it a single listing and the seller shipped the two items in two separate packages?

Exactly how many tracking numbers are there and exactly what does tracking show?

Who pays eBay fees?  The buyer or the seller?  It's the seller.  Who do you think eBay is going to do everything possible to protect?  You guessed it.  Good luck with your missing hat.  My two phone calls from eBay customer service on my missing item dispute resulted in the first one lying to me and the second one hanging up on me.

Wrong.  Ebay always protects the buyers.  To the poster,  soh.maryl 's information is correct.

eBay already has a process designed for your situation, @combsb

-- After you lose your case since tracking shows delivered, or

-- you can close the Item Not Received case yourself.

You are still allowed to to click RETURN THIS ITEM to start a return request:

-- Select the MISSING PARTS OR PIECES return reason,

-- indicate that a QUANTITY OF ONE is missing,

-- upload a photo of the box, add a comment that one of two is missing, then click Request a return.

After 3 business days if you still don't have half a refund, go back to click Ask eBay to step in. If you get a prepaid return label, return just the box to get your half refund.

Did you file an item not received case? Its almost impossible for a buyer to lose a case. Did the tracking showed delivered?

Yes I did. E-Bay allowed the seller to change the tracking to appear as if delivered on a different date which it was not. I have an E-Mail from the seller, two items, one tracking number. E-bay site even said that both items were delivered on the same date, the 24th on June. I was only given a different tracking number for the one missing item after I made a complaint that said it was delivered on the 16th of June, but was not. I still have not received the one item I paid for. After contacting the seller and he kept insisting it was delivered, he no longer would communicate with me after I stated that we need to resolve this issue. I contacted E-Bay but the seller changed the information to what it is now saying one item was delivered the 16th and 24th of June. Some investigation by E-Bay. Worthless.

Were these to be USPS deliveries? If I were you, I would go to your local p.o. and ask them to pull up the delivery addresses on their GPS monitors. They wont tell you the exact addresses, but if it was not yours, ask them for a statement that they were not delivered to you. If you cant appeal with Ebay with that info, try Paypal,(if thats how you paid)..or your cc. Good luck.

I know you are very angry about your current situation, (you have every right to be) but in this you are dead wrong. eBay protects the buyer 99 times out of 100 and the seller has to wear it.

I have tagged an eBay rep on your other thread to hopefully shed some light on the issue you are having.
