I bought this item for a Christmas gift. They quit working after one month which was AFTER the 30 day guarantee. The seller will not return my emails. I reached out to eBay for help and they said NOPE. They won't take the item back OR return my money. What a SCAM!!! I am DONE with ebay.

You can still file a claim within 180 days with paypal but you will have to pay to ship it back, or contact your credit card to do a chargeback if that was your funding source.

When you buy stuff on Ebay, there's no guarantee how long the items will last.
You only have 30 days to file a claim on Ebay.
If you paid with Pay Pal, they give you 180 days to file a claim, or file with your credit card.

I am sure you have thought about this but how about contacting the credit card company and asking them about extended warranty coverage? I have 3 credit cards and all of them offer this extended warranty coverage free just using their credit card.

There is no warranty on most items sold on eBay. The company that made the item may cover it. However, if it was not sold by a factory dealer, they might not. For some items you can purchase a warranty. Not sure how good those are.
It's not a scam so much as eBay is more of a flea-market.

Surely you're not blaming ebay cuz you wanted to take a risk and buy something secondhand for a cheaper price?!
That would be like blaming your car for running out of gas simply because you didn't put gas in it...
Buying used/secondhand goods is ALWAYS a risk and usually the risk/reward is that you get a heavy discount but you also take the chance that you will not have the item for its full expected life.
Next time pay the price for a 'new' product from the manufacturer or authorized dealer with a warranty to be sure you get it for the time you expect it to last.
That being said, if you paid with Paypal or a credit card you're STILL covered for 6 months...
Just irks me when people are so out of touch they don't even know where to place the blame properly.

Hello, how is that a scam? The reason why I'm asking is because in order for it to be a scam what you are essentially saying is that the seller or Ebay knowingly sold you the item after configuring the item to stop working after 30 days. I don't know how the seller or Ebay was able to do that, but if they were, man, those two are awesome. To be able to purposely program an item to work just right for 30 days and then to stop after the 30 days is up is some sort of heavy "magic' by either of those two.

Actually, the two options mentioned probably do not apply as, if I understand the OP's post correctly, it is not a NAD issue since the items obviously worked upon arrival so they were not NAD. Thus it would be a warranty matter. So unless the items were sold with a warranty, a NAD claim with PayPal or the OP's Credit Card company would be inappropriate and possibly be considered fraud.

I'm sorry this happened to you, but in my long lifetime I've bought a few brand new items that failed not long after the return period / guarantee / warranty expired. One of them was quite a costly item, too. It happens. It's not fraud. It's just an instance of the sorts of lumps one must take in life.
You know the next time to avoid that brand or design. As for its being a gift, it was the thought that counted, no?

It was NEW and the seller should be responsible to replace the product or refund. That is the "contract" implied when purchasing ANYTHING anywhere. Why do you think the seller won't return my calls or emails. That is more upsetting than anything. Think about it.

I'm afraid that you'll have to show me proof that any court has ruled that such an implied contract exists. Since the item was obviously working when you received it, unless the item came with a warranty, which would have to be in writing, I don't believe that you have a legal case. It would be different if the items arrived DOA then the "implied" contract to be as advertised may be a valid claim.
With regard to your filing a charge back with your credit card company, I would be very careful regarding putting in accurate details as to how long the items worked as to not do so could be construed as credit card fraud. Actually, if the items were shipped via USPS it could also be considered Mail Fraud as I understand it.

Uk Consumer Rights Act 2015 has an implied term of the contract that the goods be as described, fit for purpose and of satisfactory quality. But this only applies if buying from a business and not an individual.
