Rare coin sales tax

I have just been charged with sales tax on numismatic coin purchases from Arizona, California, Connecticut, and Colorado. From my research only California should be applied. This all started with the new July 1st rules.

Re: Rare coin sales tax

@badlands3  Sales tax is charged by the state the item was delivered to, not where the seller is located.

Here's a list of the states that eBay is required to collect and remit sales tax for:

Florida just added marketplace sales tax on 7/1

Re: Rare coin sales tax

On June 21, 2018, the Supreme Court of the United States ruled in favor of the state in South
Dakota v. Wayfair, Inc. The decision allows states to tax remote sales. The sales tax is
charged by the state the item is delivered to for all internet / remote purchases.

The market place facilitator tax law explained:

Florida and Kansas started charging these taxes beginning July 1, 2021.

Re: Rare coin sales tax

The last I read about FL sales tax rules, US rare coins are still exempt. As is in the other states on my list except California where the purchase must be above $1500.

Re: Rare coin sales tax

@badlands3   If the sales tax should not be charged then I would suggest contacting your state tax authority to report this.    Again remember the sales tax is being charged based on the state the coins are delivered to, not where the seller is located.

You can also contact customer service with the item #'s, date of purchase and see if they will credit you for the sale tax, this is a long shot.  Be sure to have the documentation from Florida tax law that says that the sales tax should not be charged.

Your best chance for help with this is on social media.  The agents on social media are more experienced.

1 . https://www.ebay.com/help/account/contact-ebay/contact-ebay?id=4379&st=12&pos=1&query=Contact%20eBay...

Scroll to the bottom of the screen, click "contact us"  Drill down to the topic you need assistance with.

Then on the left hand side select chat with automated assistant.  When the chat box pops up if live help is needed click "see more" then click "contact an agent". This bypasses the chat bot and you can either chat with or get a call back from a real person.

If you are using a cell phone turn off the spam filter or it may block the call back

2. Or you can also contact customer service by sending a private message on social media. You leave a message and an eBay employee will get back to you as soon as possible. To speed things up you can leave your registered account information in the PRIVATE message: Full name, address, phone number, email address, user ID, and a brief explanation of your problem.

Re: Rare coin sales tax

Found this bad news in the new tax law:

(j)1. Notwithstanding any other provision of this chapter, there is hereby
levied a tax on the sale, use, consumption, or storage for use in this state of
any coin or currency, whether in circulation or not, when such coin or
currency:
a. Is not legal tender;
b. If legal tender, is sold, exchanged, or traded at a rate in excess of its
face value; or
c. Is sold, exchanged, or traded at a rate based on its precious metal
content.
