Buyer's cancellation

Hi, I brought an Italian classic scooter on March 6th, seller printed out the packing slips but, has been shipped. Sellers blame Fedex for not picking up the pallet, today, 11 days passed and I dont know what to think anymore? Is the seller trying to scam me? Should I cancel the order? Where did you find the listing for the scooter?  If it was on Facebook Marketplace, Craig's List  or other online site that had info saying the sale was protected by ebay, and asked for payment using ebay gift cards, then it was a scam, and one of the oldest ones in online shopping.  eBay's protections only apply to purchases found on the ebay site, and gift cards payments are not traceable.

Further if you did find the scooter on ebay,  The shipping cost should have been given as Freight, since palletized items shipping costs are determined by the size and weight of the item and pallet.  Home delivery is not possible if the recipient cannot provide a way to remove the item from a truck, shipping dock, lift gate, or forklift.  While eBay Motors listings are non binding like standard listings are, payment should be withheld or escrowed, until the vehicle has been inspected and approved by the buyer or their agent.

You cannot unilaterally cancel an ebay transaction that has been paid for. The seller would have to agree to cancel as well before a full refund can be issued.

OK, I found the scooter in Ebay Italy, I paid using my Apple Card through EBay. Now, seller prints out packing slips so shows on Ebay as shipped! with a delivery date that keeps changing every day. I contacted the seller and told me that the 60Kg pallet is ready for pick up by Fedex. According to the seller the Fedex man keeps changing the pick up day. Im no naive neither trying to "unilaterally" cancel an Ebay order, I just trying to dont get robed! Im checking the Fedex website and shows nothing because they dont have the package yet. What happens if the seller dont agree to cancel the order?

Since you are located in Spain is your home site's address (  ebay.com.es )  or do you use the U.S. based site ( ebay.com ) ?  Did you find the listing for the scooter on the Spanish site or did you login to the Italian based site, ( ebay.it )? 

While all of the site's have a version of ebay's Money Back Guarantee, there are differences in some of the policies. The information I provided is from the U.S. based site ebay.com whose community you have posted on,  and there may be some differences.

 Basically if you do an online search for  "ebay money back guarantee, ebay.com.es"  You will get information on the terms and time frames for using the site's guarantee.  It should say that the item has to be delivered by the date given on the listing or you can file an item not received dispute.

Go to your Purchase History and click on the Order details button. That will give you the last estimated delivery date you should receive the item by.  When you click on the listing title the estimated delivery date on it will change to show a date if you buy the item on the day you open it.

If you have not received the scooter by one day after the date shown in the Order Details. go back to your purchase history, click on the More Actions button and a menu should drop down, that has an option for I have not received the item.  If it does not show that, then click on the Return item button, and the menu will appear.

When a seller prints a shipping label, ebay's system shows the item as shipped but also Untracked.  The tracking information from the FedEx site will only show that a shipping label has been printed and that they are waiting to receive or pickup the package.

I bit confusing I know, Im from the US but, relocated to Spain now so, I changed my Ebay address to get deliveries here. The buyer sent me a copy of the Fedex packing labels with a tracking #. As you mentioned, Fedex website shows waiting to receive the package and Ebay shows shipped "untracked".  So far, the seller only paid the shipping and that's all. Sold an item for 750 and paid 10% of that on shipping charges. If he never ships the item he will be making 675 euros profit. If nothing changes this week, I have no other choice to cancel the purchase through Ebay and dispute my apple card charge as well. Very hard to do online biz nowadays. Thanking you in advance.

The site address for Spain that I gave you is from an old international ebay site list, and the site address has changed to www.ebay.es   Below is a screen shot with a link to the ebay. es site's guarantee click on the Mas Informacion  button.
