Buyer requested return for “damaged” box and claims item won’t turn on. .

Hi, I recently sold an item on eBay and it is a very popular item in demand. The item was delivered, buyer accepted the package, and the buyer wanted to return the item after three days claiming the package was damaged and the product does not power on. I told the buyer to please send me a picture of the damaged box and I will accept the return, and fully refund the item once I see it does not turn on. But the buyer was silent so I took that as he refused when I have asked twice and instead demanded I refund him and if I don’t he will get eBay to step in and have me do it. I accepted the return and have asked the buyer to let them know I have accepted the return and to make sure they got the label that was sent to them. I asked if they have dropped off the package and if they have not done so, could they please provide tracking info so I know when to be expecting the item back. I have also stated that I do check Serial Numbers as I have them recorded to ensure that I get the right product back and it is not an item swap. The buyer to me seems to not be communicating with me for wrong reasons and I believe this to be the buyer simply no longer wanted the product and found it cheaper elsewhere and is falsely describing the item as broken and not working to make sure they get a guaranteed refund no matter what since eBay seems to rule in the buyers favor 95 percent of the time because of money back guarantee policy. I also believe this to be the buyer is abusing the money back guarantee policy while treating the product I sold as new a free trial. They also claim since the item was shipped through fed ex, that means they can claim the item not as described. And if I get the product back in working condition as I mean it turns on, then everything they say has been a lie and destroys their claims they have made. Even if the package is delivered back to me in working condition, I would like to simply send a partial refund or send the item back if it works.  But sending it back would mean I risk the “damage” claim they will use against me again if they are lying. How should I move forward with this matter?

If the buyer files a refund request saying that the item is not as described then you need to accept the return and issue the return shipping label.  

The eBay Money Back Guarantee overrules your returns policy.   Your return policy only applies if the buyer files a buyer's remorse return:  Doesn't fit, changed mind, etc.  

If you do not accept the return willingly then the buyer can ask eBay to step in and forces a refund. You do not get your seller's fees back, you get a defect and the buyer may be allowed to keep the item.

If the buyer abuses the eBay MBG in some way then you can report them but it doesn't get your money back:

Sellers have protection for return abuse if they offer FREE RETURN shipping on their listings OR if they are a Top Rated seller and offer 30 days or greater returns.  The seller can then reduce the refund amount by up to 50% if the buyer sends a different item or somehow reduces the value of the item.
