Buyer Filed a FALSE Item not as described claim... What should I do?

Hi I am a new seller and I had a buyer file an item not as described claim against me but then messaged me and said they wanted a refund because the items did not meet their expectations and then stated that the item was worn, but i listed the items as used and posted several pictures plus I described them as they were and posted that they were sold as is no returns and to ask any questions before bidding but the buyer never asked any questions. Then the buyer took nine days to file the case? This seems like she had buyers remorse to me and is misusing the system but I am new to this so maybe I misunderstood it. The reason I don't like to do returns is because its time consuming and a hassle. I don't think I should have to refund their money this is the second buyer who has done this. What should I do?? I would really appreciate any advice that would help me. Thanks

There is nothing that can be done. Incurring losses due to unreasonable customers and crooks is just another cost of doing business here. The fact of matter is, eBay always finds in favor of the buyer no matter what the scenario is. I don't even think a real person looks into the details. eBay is a publicly traded company whose only interest is in making money & doesn't really care about the seller, or the buyer either for that matter. They are going to do whatever is best for their bottom line - they are not at all concerned about what is right and wrong.  There is no moral compass or standard of integrity in their business model.

Hi, Im just researching Ebay claims etc and read your issue. Why NOT let us know the name of her store? Do not tell any tails simply truths and NO deprivation case can be brought against you. Simply advise everyone of where and whom is selling on  your ebay items. Or find out what lable is being put on your used items in her store and report her to consumer affairs. It is sooooo wrong that people get away with that. As for the item being returned to you, as previously said DO NOT REFUND A DIME before you get item back. and if its NOT registered tracking then say you never got it! Two negatives = posative .

I personally would go out of my way to teach her a leason in morality and fair trade. Like place a fake order with her store and waist her time sorting and packing. or even better still call the store and say you saw the items for sale and wanted to buy them both if she could hold on to them for 3 weeks please. Then her window to claim closes! I could go on as I now have a bee in my bonnet.! 🙂 I feel for you and wish you well in future trading.

I am on the other side of the table with my Ebay issue. I purchased a $487 item that was NOT as described (wrong modle) I returned item to seller withing 3 days registered post. and the seller refused to accept package hence it was sent back to customs for holding after 3 attempted deliveries. I opened a claim with Ebay's Money back guarrante and after months of back and forth they suggested for me to contact PayPal to make a claim, which I did. PayPal closed teh claim in 12 hrs saying too much time had past, I then got an EMail from Ebay saying we see you have opened a claim with PayPal and that I can only have one claim in play hence they can no longer help me with a refund! I tried to explain to Ebay that I wish to proceed with the 1st claim and I now get different people saying sorry we can not find any file of this claim please tell us what the issue is!   So damb frustraiting, I juat want someone with Legal knowledge to help me sue them civil claim or what ever, their cop out is so laim. Anyhow thats my gripe 🙂 all the best

Basically don't sell because you may have to refund money even if they have buyers remorse. I will now sell items that I know have a small chance of being returned. I would rather sell at a swap meet at least there is no shipping , paypal fees ebay fees a d no returns.

So I've got one going on right now that "is about to be escalated" here is the transcript that basically shows she just doesn't like the piece, despite me having a no return policy - certainly want the piece back if eBay will make me refund their money, though - thoughts?

SMH ... just got a message from eBay - Buyer to return, they sent shipping label, if used, I will be charged - unbelievable.

Hi, @settiasueboutique ~ thanks for stopping by the Part Time eBay Sellers Group home!  We are here to help with all of your buying and selling problems/concerns, and FYI, you will probably get a quicker response in the future if you start a new thread rather than adding to an existing and usually very old thread.  As for your current concern...

 

...I feel your pain on this one and you are most likely correct in that it is a case of buyer's remorse and not a snad...however, the buyers last message stating that the pictures were not detailed enough to show the true condition of the item is the one that will make it a true "not as described". 

 

Your only option at this point in time is to refund the buyer within 2 days once you have received the necklace back and then file an appeal with eBay ~ but I wouldn't bother and as a fellow seller, I have learned that there is always going to be a liar buyer at some point in my selling career.  Best to just move on!

Thanks - it's one thing if I sent the wrong piece, it was damaged, or misrepresented in the description - but admittedly, that's not the case. She probably the kind of person and complains about every dinner out and tries to get comped meals. But then to make me pay for return shipping as well? I'm not Zappos. Don't know about you, but I know I don't buy things on eBay unless I am sure I know what I am getting. She could have easily asked for a specific picture, with I have done with other satisfied buyers.

ebay seems to be siding with the buyers. These buyers now know they can pay 100 dollars for something, then file a claim and end up paying 50 bucks for the item after eBay sides with them. Just not fair. ebay is going to lose business shortly if they keep this policy going. No one will dare to use ebay for fear of being scammed by the buyer.

Hi, I have the same case that happened to me. The buyer filed a dispute saying the item was not as described. However, as the date it was sold on July 18/2018 until now has been more than 45days. Would ebay still Side with me since they have exceeded the buyer protection period?

Hello @justincao88  A buyer has 30 days from the date of receiving the item to file a return request/claim on eBay.  The buyer also has 180 days to file a claim with PayPal.  If you will provide more detail about the transaction, i.e., listing number,  terms of sale, etc. we can try to help you figure out how to proceed.

So I sold a purifying water system to a guy in Malaysia. After receiving it, he told me it was damaged even though I shipped it with bubble wrap carefully and the item was complete.

He then bargained with me to refund him the money that he had paid for the cost of fixing. I agreed to pay him 10$ ( which I haven't sent him yet due to school exams week) instead of the $50 dollars he requested.

I knew that he was trying to get more discount from this item with his bargains. 

Due to school, I was not keeping up with the notification, but later I received an Email from Paypal saying he has filed a dispute for 100$ ( AFter 50day of using the item) even though we only agreed on 10$ which I did document from the eBay msg box.  I just called PayPal today. I was very surprised the 45 days with PP has increased 180days which is not in the best interest of the sellers. Hopefully, he will accept the 10$ and stop bothering me. otherwise, I will upload the documents from our conversation and eventually, PP will favor my side of the story.

I checked your listing and found that you are shipping internationally using the eBay Global Shipping Program which means that you are only responsible to get the item to the KY shipping center without damage...when an international buyer files for damage on eBay, the seller calls eBay CS and asks for an GSP specialist and the "claim" is handled by them and refunded through eBay and not through the seller.

 

You will have to call PayPal and let them know that it is a GSP sale and ask how to proceed, however, since you missed the timeframe deadline, you may have a problem.  So sorry that this happened and please let us know what PayPal has said...good luck!
