After some thought, I think the seller should have refunded me and cancelled the transaction, if he could not fulfill my request, thus avoiding the destruction of the item.

I had just moved here and didn't know anyone well enough to ask, I don't even have any of their contact info. I was already gone when I purchased a hard to find item. Seller had already filed a non-payment when I tried to delay payment.
