Buyer claimed my item was open & sent photos of the top of package cut open- My photos clearly show the top ( and bottom sealed) why does ebay even allow a case to be open?

If an item is Deemed LOST - under buyer protection does the refund come from EBAY or the seller? Seller shipped & tracking proves that.
