USPS missing return, questions.

I bought an item which broke within a week of purchase, opened a return, and seller agreed to a refund upon return, eBay sent a USPS Priority Mail shipping label. I printed out the label, placed it on the package, and scheduled a pickup at my address. I never scheduled a pickup before, but my porch is isolated from the sidewalk, I have never had a package stolen in the ten years I've lived here, and sometimes packages would be on the porch for days while I was on vacation with no problem. So I figured it would be okay. Anyway, I scheduled a pickup for January 23rd, USPS never came to pick up the package. It was on the porch all day. The next day it was snowing/raining, I placed a letter on my mailbox telling the carrier to pickup the package as I scheduled a pickup yesterday and they never picked it up. The package was hidden in the location where packages are usually left on the porch.  I left for work around 6 A.M. 

At about 8:15 A.M I received and email from USPS saying, "We have successfully completed your package pickup." I texted my housemate and asked him to check if they picked it up. It was still there. My housemate went to work at about 9 A.M, when he returned at 1 P.M the package was gone. We assumed that the carrier picked it up when he delivered the mail (the mail was in the mail box.) 

Later that night, I put my pickup confirmation # into USPS's website to double-check, and it said,  "Status: Canceled." 

The next day I attempted to email and call USPS to figure out if they picked up the package, as the tracking information didn't update. They said that they will contact the local post office. On Saturday the 26th, I got a call from the USPS office at the sending location (in Illinois, I live outside of Pittsburgh.) She said that they need to call my  local post office. 

On Sunday, the status of the inquiry was listed as "Case closed." Additionally, the tracking number still then (and now) hasn't been updated since the assumed pickup. 

I emailed and called USPS again on Monday, and they said the case is still open until the 30th, I'll get an email from them after then. 

Yesterday, I went to my local post office and they called the carrier who remembers picking up a package from "1X35" when my address is "1X45" a few doors down. The supervisor said the carrier probably did pick up the package, and just mis-remembers the address. He told me to open up an insurance claim on USPS's website and that will make them look for the package more thoroughly. The insurance only covers $50 on the item (which I bought for $360), but yesterday I opened up a claim, which it said that since I opened the claim too early it might be automatically denied. Will that still push them to look more thoroughly? Should I open up another claim after it is denied? 

Today I emailed the seller, telling them that it might take a while for the package to get to them, or the package might be lost for good. I also called an Ebay representative asking about what happens if the seller receives the package in a few weeks (especially now that the weather looks like there might be even more delay.) They gave contradictory information, telling me that it is either the "seller's discretion" or they must give me a refund if they receive it. 

 

My questions are:

 

  • What are the chances that my item is found by the post office assuming that the carrier did pick it up (which seems likely as it is not that likely that somebody would enter the path to my porch and take the package on a rainy day in a four hour time window when I haven't had problem with theft ever, and my street isn't busy.  
  • If the item does reach the seller in say a week or two and it shows in the tracking, are they obligated by eBay to refund or do they have "discretion" as the representative stated? If they refuse, do they have to send the package back to me? 
  • Is there a chance that the seller receives the package, but USPS never updates the tracking information? I think the label says that it requires a signature, would that make a difference? The seller is also an organized company and the package is going to what seems like a dedicated returns department. So I don't think that is likely, but I am still wondering if it could happen. 

 

Right now, I pretty much resigned the $360 (minus maybe the $50 insurance) as gone, but I just want to know if there is anything else to do that I haven't done already which will increase the chances of the package being found.

My local post office called me today, and they said that they think it was stolen off the porch since it would've been scanned by now. I felt pretty bummed and resigned to giving up, but an hour after they called I just got a message that the package was Delivered to the proper address. Boy do I feel relieved.

Thanks all for the help, thought I would leave an update in case anybody has a similar problem in the future.

sam seems to have a 10 word limit.

 

Unfortunately it sounds like there is no "acceptance" scan on the tracking.  Is that the case?  Are there any scans showing on the tracking?  If you don't have any tracking scans at this point you are likely out of luck.  If there are scans then you may be able to get eBay to grant an extension on the time it takes for the item to reach the seller.   

 

If my some chance the item gets a delivered scan before eBay closes the return you would be refunded, but if there's no scans at this point it's probably not going to happen.

 

In the future I would recommend dropping off returns at the Post Office and getting an acceptance scan, especially if it's over your comfort level for taking a loss.

Yes, it still shows as if I merely printed the label. The label was somewhat faded, so I figured that could possibly have affected the ability to scan it, but the USPS representatives said the carrier could've just entered the number below the barcode if the scan doesn't work. On Ebay my shipping status looks like this, the "IN_TRANSIT" inquiries made it look as if I shipped it, so I think that keeps the return status open?

Yeah, personally I probably won't choose to use USPS if I sell (or I guess now return anything) I'd rather pay more to UPS as they have reliable tracking and customer service unlike USPS. But I definitely will remember this if I ever do have to deal with USPS again. I mostly use eBay for buying stuff anyway, unfortunately I've been pretty unlucky this time around.

Unfortunately, if the label was an eBay issued Priority Mail Return Service label there is no insurance coverage.

The chances of it being found are pretty high in my experience...if the post office actually picked the package up. I can't tell if you filed a missing mail search or if you went straight to filing an insurance claim. If you  haven't done so, you can file a missing mail search on the usps website using the tracking number.

 

If the item is showing as on it's way to the seller, ebay will likely leave the return open awhile longer; particularly with the weather issues currently happening.

 

If the tracking never shows it delivers or if the item truly is lost, you are unfortunately out of the money.

 

I had this happen once....where a buyer sent a return back and it got lost in the mail and I never received it. After about 10 days ebay closed the return in my favor (I called in to ask what to do). It was for a $110 wallet. I think that ebay may have refunded the buyer too as she only contacted me once and I told her I couldn't refund her without the wallet returned. She was upset, but never contacted me again or filed chargeback or anything so I believe ebay refunded her. I felt bad for her, but I can't afford paying $110 for an item I don't have. And legally she owns it until it is returned to me. 

 

In the future, I would always drop off in person and get a scan in receipt from the post office. I would also insure privately with Shipsurance just in case expensive items get lost or damaged. Shipsurance will cover the full amount. They require a drop off scan. The post office might require it too for their insurance. However, in your case, I would use the email they sent you as evidence that they picked it up.

My experience is different.  I had a buyer file a Returns Request, because she stated that one of the figures in the set couldn't stand up because one leg was shorter than the other.  I accepted the return.  I could see the tracking but the package never showed up and it never stated DELIVERED.  I waited for several days just in case it shows up.  The buyer was tired of waiting and called ebay, and ebay closed the return and charged my account.  I called them to ask why since tracking never stated the package was delivered.  I was told that since I provided the label, I was ultimately responsible for paying the refund.

That’s ridiculous. I would have called back until I got a reasonable rep. eBay rests their hat on delivery scans. The buyer is legally responsible for the item until it is delivered to you. If eBay wanted to refund the buyer they should have covered it. If that was recent I would call eBay.

Thanks all for the replies. I filed a missing item report too, and was told by a USPS representative (after calling again yesterday) to call the postal investigators too, which I might do today. The package has the tracking info inside it so if the label was damaged they should be able to use that to identify it. 

Fortunately, my seller has been really good about it all, they replied to my message with. 

"Thank you for the information. Please don't worry, we'll be waiting for the item. As soon as we get it full refund will be issued automatically. 

Thank you for your cooperation and understanding. "

 

So it is really up to the post office now. I am pretty confident they have the package somewhere.

eBay does not agree on what we deem is ridiculous: If a package is lost, whoever paid for the label is responsible, as explained in e.g. this post.

 

It's been repeated over and over: For more, research what brian.t@ebay, same team, different person, said on the matter.

First of all the item was a laptop described as functioning which stopped powering on a week after purchase after experiencing problems for that entire week. How that qualifies as my having "broke" the product I have no idea. An item like this should last more than a week, and it is good that eBay's policy protects the customer on this. Things would be different if I had the product for a month or two and tried to use SNAD as a warranty which I wasn't. Additionally the seller listed a 30 day warranty for all of their products anyway. 

 

The seller was fine with refunding upon return anyway, and in fact was apolegetic that the item broke so soon and any inconvenience it has caused.

 

As an external party with no skin in the game and no knowledge about what is wrong with the item you can kindly shoe off please.

Public board so you do not get to decide who can comment.

Your post shows item is in transit so what is your concern?Ebay just requires item be in the mail stream within  5 days.There is not delivery date requirement
