Hi, I am trying to figure out if I did the right thing here. I had a seller who was very nice and I asked to ship something out for me quickly because it is something I needed in a certain time window.
So, the seller kindly shipped the package out for me, which i was appreciative of. However, the package got lost in transit. It was scanned in by the local post office and never scanned at another distribution center or anywhere. It has been 1/2 a month and I never got the package. The item is several 100 dollars(Also, another reason the seller cant be sitting on an item for 1/2 a month and me have no item to show for it). After talking to my local supervisor at my post office he said the package was lost and that there was nothing more they could do.
However, since the seller was so nice to me I kindly asked the seller to file a missing package claim on his end so he can get his money back and refund me through private message so nothing would go against him. I, also told him I would refuse the package if it showed up one day down the road so he would get it. However, the seller refused to refund me and would never look into the missing package for me. So, now i opened a case against him and he is still refusing to refund me....Ebay should refund me in this case correct? I did do the right thing by opening a case against him? His attitude changed very quickly once he learned I wanted a refund.

I typically buy from amazon 99% of the time, but the particular product was only available on ebay so I had no other choice. I get a lot more people are ordering online however, but the COVID-19 stuff is being thrown around as an excuse for everything now. Not to mention I have been having issues with the postal service far before the COVID-19 issues. I have had problems with my local post office for the past 6 years and COVID can't be used an excuse for that. All COVID-19 did was expose their already existing flawed system and with less help it has made it worse.
Their system is broke and needs to be privatized. The government keeps bailing them out every time they have a problem and that is why they think they can do whatever they want and things we be OK. This is why both UPS and Fedex do a better job than them. Far less issues as a whole.
As far as amazon the most delay I ever have on a package is 1 day, but most of the time it is on time or even early. Amazon also has their own carriers and they make their employees take pictures of their packages upon delivery, etc. USPS needs to take notes here as this proves when something is delivered. I have had packages saying delivered many times around me and guess what they delivered it to another town/area and I had to jump through hoops to get my money back because it was hard to prove that I never actually got the package.

You seem to be under the impression that expedited shipping has some sort of guarantee with it, It doesn't, it has a target time which in this current climate is virtually impossible to be met, target times are an estimate not a guarantee.
Shipping UPS or Fedex would more than likely be considerably more and the time for requesting a different service is before purchase, no idea why you think you should be refunded shipping, you paid for it the seller shipped it you're about to receive it.
Your only gripe is that it had a delay, how is that a sellers fault ? As you said yourself the tracking stated arriving late, what do you expect any seller to do about that, these boards are full of people blaming someone for something entirely out of their control.
If you needed a time sensitive package you should have asked for overnight or a different service.
Expecting something guaranteed by expedited ( Priority Shipping ) is totally unreasonable.
If the seller has uploaded tracking to your case and it now gets delivered you will lose.
I also would not be refunding because it doesn't suit what you think is the correct time frame to be delivered, every seller here are having many delays.
Your expectations on a time sensitive delivery are not reasonable in the current climate with the service you chose.

I told the seller I needed the item quickly before even bidding on the item and he said this wasn't an issue. I would have gladly paid more for shipping but he said it wouldn't be an issue the way he was shipping it. Additionally like i said i paid $50 for shipping and for sure it could have been shipped fedex or UPS for that price I looked myself.
The issue and my frustration is this seller was unwilling to even look to see where the package was I told him the package hadn't moved in like 3 days and i was concerned. It wasn't until 2 weeks later and me filing a claim did he choose to contact the postal service and file a missing package claim. I shouldn't have had to do his job and force his hand in order to get a result.
Also, the package was shipped priority 2 day and it took 2 weeks. How is that reasonable in any climate? I think my expectations are perfectly fine. It boils down to the seller had to file a claim which he was refusing to do. The package was actually lost. He was able to describe the package that was lost that myself and my local post office had no idea.
I just ordered another package off ebay shipped the exact same way from the same state and got the package in 2 days.
I have plenty of reasons for disliking the post office and it has nothing to do with COVID like i stated the USPS has been terrible for years and years before this! I have been selling and buying for years I have had tons of bad experiences like this one.
What should happen in reality is the seller should be refunded his money for the shipping due to all the issues and I should be as well.

There are millions of packages showing 'in transit, arriving late'... so I wouldn't jump to conclusions that it is 'lost'. I've had 8 packages the past 2 weeks state that, and within 3-5 days, they 'move' again, and deliver another 3-5 days. So, 1st class takes 2-24 days, Priority takes 2-10 days...typically, for now.

Actually, I believe the OP paid for overnight/expedited shipping; that was what the $50 was for. Having a package with everything but personal courier delivery should have gotten better service.

Just had a 2 day Priority take 2 weeks to get delivered.
Took 9 days to make it the last 20 miles.
It was not my (the seller's) fault.
The seller can not see anything more when checking the status of a package than you can. There is no "magical" sellers "hot line" to USPS.
Sorry this happened to you.
As with what another posted, I see many items that I have shipped showing "arriving late".

That post office supervisor is talking absolute rubbish, USPS will not even accept a claim for lost with Priority mail until a full 15 days since the mailing date has passed and no later than 60 days so you might want to address that fact with them. Nothing is considered lost until then, they lied to get you out the building.
Submitting a missing package request is entirely different to a claim, again something your PO should have explained to you, you can simply go to USPS.com track and sign up for e mail alerts, trust me this updates far quicker than E Bay does.
Many packages are not being scanned correctly, I had a priority package with 2 scans the other day, acceptance and delivery with a simple in transit in between, that's just how it is at the moment.
As a seller yourself with a 10 day handling time i think you should be more aware of the severe postal delays and expecting a package unless overnighted within days at the moment is totally unreasonable.
So once the tracking shows delivered as it's now at your distribution centre the case will close in the sellers favor.
If you need to return the postage is on you, delays are no sellers fault if they shipped on time., do the right thing.

To add to some of the other answers:
1) “buyers remorse” is the catch-all phrase Ebay uses for a wide range of return reasons, from the buyer changing their mind to clothing that doesn’t fit.
2) Never, and I mean NEVER refuse delivery of an Ebay package. When you do that, you lose ALL buyer protection and have no recourse.

The seller is 100% responsible for the package until it get to the buyer.

I had a $100.00 package shipped to a buyer 50 miles away. It took 25 days to get to him via USPS 1st class.

I dont ship as much as most sellers on here because this is just a side gig for me, but that being said over the last 3/4 of a year I have shipped 100's of packages and not once did I have this happen to a seller. Also, if a package is stuck in transit and a customer requests me to look into I do. I don't tell my seller that there is no need to look into it and say they are not going to do anything. If a customer bought the package from me then it is my responsibility to look into until the customer gets the package. This is not the way I was treated and thus why I am not happy about this whole thing.
I also just had 2 packages come to me from approximately the same area and around the same time both got to me within 2 to 3 days.

Just so you are aware I did end up closing the case because the item did arrive. However, I have learned my lesson on ebay especially any item that I want by a certain time period will not be using USPS. I will specifically request to use UPS or FEDEX even though I know it is going to cost more.
I will say this on amazon I almost never have issues with USPS, but however, on ebay this is becoming more common. My guess is Amazon packages are priority over anything else and that is why I have less issues. I have heard postal workers that I know say Amazon packages are priority over any other packages and what keeps happening seems to prove this point.

You are a seller yourself. I'm really surprised that given the current postal climate that you are holding them on the chopping block like that. What if one on your shipments got delayed or lost?

It is the seller's responsibility to track down the package, not yours. You have already bent over backwards to help the seller out. If it's past the estimated delivery date just open the claim for an item not received and get your money back. If the package shows up later then you can have USPS send it back to the seller.

If you return it to the seller without his approval, you risk not getting any money back.
Just keep the item since you paid for it or resell it and let it go at that.
