Something doesn't look right

I sold a game in mint condition about a week ago. Today I received a message from the buyer saying that the game arrived damaged, The buyer even provided pictures of said damage game. But when I look at the pictures the damage to the package, game and case don't add up.

The case looks used and dirty, (definitely not what I sent) The packaging looks like it was cut with a knife and picked at, And to top it all off where the case was damaged definitely doesn't match up with the damage to the package or the disk.

The buyer said (His exact words from the message I received) Hello, I'm very disappointed and very nervous that such a damage came to my item. The disc is also checked and it does not work, probably damaged, Please send me a new item or return my money.

 

Do you think I have a leg to stand on if I chose to fight this or should I just cave and let yet another scammer get away with scr*wing over us sellers

You have no leg to stand on. You know about the money back guarantee and how it works right? And how would you feel if you were the buyer and your seller didn’t package the item properly resulting in shipping damage and the seller tried fighting you on it?

But it was packed properly. I've sold many games and I've never had a problem before.

 No typical or common post office damage, the picture of package was in pristine condition with only a couple of holes in it. No signs of it being crushed, stuck in the sorting machine or anything else. 

I have had many things delivered to me by the post office for years and I know when something was damaged by them. This package was definitely not damaged by the post office.

That’s not properly packaged. Regardless, you still have no leg to stand on. The money back guarantee holds YOU responsible period. It doesn’t matter if you did or didn’t pack properly, you are responsible for getting the item to the buyer safely.

Really, that's not packaged properly!?

 

The damaged things I was talking about had nothing to do with me selling stuff, I was referring to things I have bought from different company's in past years.

This is the first time someone has complained about a package.

Well, then, if you think it was properly packaged, go ahead and fight the return. But be aware that if you do and you lose, then a defect will be placed on your account.

If the buyer has not filed a SNAD complaint, don't do anything.

If the buyer opens a claim with eBay saying the item is not as described, defective or damaged you are out of luck. It doesn't matter that it looks like the mailer was poked with a pen or that the item's damage is in a different location. eBay doesn't know what you shipped or what the buyer received so they will take the buyer's side.

 

Has the buyer opened a case or did they send an eBay message? If they opened a case then you need to respond before the date on the case. If you let that date lapse and eBay has to step in you will receive a defect on your account.

You would think that USPS would have marked/stamped the damage, and let's not even touch on the fact that the item sent does not qualify for "media mail' rates.

He rented the game to play, finished it and is sending it back on your dime. There is nothing you can do except report him to ebay and hope others have reported him too.

 

If he opens a case tell him to return it.

 

Your packaging is fine that is how I ship things like that BUT sometimes it will get damaged that way. I know that but damage to 1 out of 200 items sent is not worth the increase cost in supplies and shipping costs.

Okay I thought that's what you meant but I wasn't sure.
No they only messaged me and I have not replied back to them as of yet.
I do want to confront them about how the package looks like they tampered with it and the fact that the damage to the case doesn't match up with the way I put the game in the envelope and the damage to the disk is impossible to achieve unless the case was crushed, and that that case is absolutely not the one I sent.
But I haven't said jack.

You definitely would have thought usps would have marked it damaged if they did it.
But all you have to do is look at the package and see it was done by the buyer
