Shipping problems

As title says I have problems with shipping being somewhat weird and frustrating Back in late october I bought something from a seller in California ,the seller seems nice and cooperative, provided a tracking number. The package traveled from California to Austria with no problems but then something went wrong there and was stuck in Austria for 2 weeks and went back to American. Again got stoped  in Austria and went back to America and keeps going back and forth and im from Slovenia.

Estimated delivery  Nov 14, 2019 - Dec 17, 2019 , tracking is LH079265188US

I dont know but im assuming the seller must˙ve messed up the shipping labels or something, what else could it be ?, when I asked him if he could call up UPS and have them manually pull the package or anything he said  "its out of their hands".He said "when it comes back he will resend it but it could take up to 3 months" Should I wait or what, do packages like this ever get send back ?

You will NOT get anything from him, and if you wait three months you won't be able to make a claim for non-delivery. The seller is trying to delay you so he doesn't have to refund.  Go to Paypal if that is what you used to pay, and start the claim process for non-receipt.  Paypal gives you 180 days but do NOT wait!  If you didn't use Paypal, go to your credit card company and make the same claim.  I don't know what you have for payment sources in your country, but use what you can to get a refund.

How many days after the estimated delivery do I have to file a claim of not receiving item and getting my money back , I heard somewhere its 30 days, it might still show up so i wanna wait as long as i can.

I used Visa card ,form what I understand the refund goes to your "paypal account" and then takes some days to appear on your credit card, the problem is that I really need this item and not many sellers are selling it.
