Seller is using "Open Box" instead of "Used" status of the item

Hello guys,

 

Found a smartwatch on ebay, listed as Open Box, that clearly has scratches on it's bezel on the pictures. As far as I understand, this automatically makes the item Used instead of Open Box, since according to ebay Open Box is "Open box: The item is in excellent, new condition with no wear". And scratches indicate wear.

I contacted the seller, saying he should update a description, with no response, and the listing still says Open Box. There's no way to report this listing, there's no option for a wrong description

My question would be, can I buy it, and then ask for a refund while keeping the watch, since it didn't match the description?

You could buy it and then ask for a refund, sure. 
The seller may send you a shipping label to return the item before refund.

Seems a lot of work and to have your $ tied up...

 

If you tried to tell the seller And Cant report the item I would move on and not waste my time

You could buy it and then ask for a refund, sure.

No, if you buy it and open a not as described case, you will need to return it for a refund. Which is kind of a waste of time. On the off chance the seller screws up and eBay does let you keep the item and your money, that's what some people call stealing.

Wow most scammers don't openly admit they're trying to scam... good for you for admitting you want to scam the seller

If a buyer wants new, then used, open, returned is not for them.  Scratches can be found on new items too. Could by why it's for sale as an open box item. Could have been rejected at that point and was never used or sold.

 

No you can't keep and item and also receive a refund at the same time.

Some sellers selling watches have the following possibilities: open box, excellent, very good, good

Other sellers only have open box or used. Consequently as one of those sellers what do I do if I have a very nice watch with a small unimportant cosmetic imperfection.  IS it fair having to sell it as used. I would have preferred to list it as "excellent" and then describe the small imperfection.

Unfortunately as the EBAY rules are I do not have this choice
