Seller claims it`s shipping damage

Hello:) I hope someone can help me because im pretty lost in this case. The background is that i bought a analog camera from japan in Exc+++++ condition . When the shipment arrives it`s a small dent in the box, not much. The camera was very well packaged inside the box. When i test the camera and get my film roll developed  it shows that the camera has severe front focus issues and problem with the shutter, so some of my film frames are blank.

I contact the seller and he says it must have happen during shipping and want me to report to ebay shipping damage and i must fill out a shipping damage claim in the post office. What should i do? should i insist that the item is not in the condition as described, or should i should fill out a claim on ebay and the post office that the item was damaged during shipping. I know that if the object is "not as descibed in the listing" i am covered by ebay money, but i don`t think i am covered if its a case of shipping damage, which to me seems unlikely .

Sellers are responsible to get your item to you in the condition stated.

Thank you for the reply. The problem is that he think the condition/problem is due to shipping, and therefore i should report shipping damage. I on the other hand think the problem was there before it was shipped, and therefore i received an item that doesn't match the listing description.

As already stated they are responsible to get it to you in condition stated.

If you feel the damage was there beforehand then opn the INAD case.

If you feel it was shipping damage open the INAD case.


The point is the item is not as described

This answer is correct:

Sellers are responsible to get your item to you in the condition stated.

The seller is responsible no matter how it got damaged.  Open an INAD case in the eBay resolution Center.  You can assist the seller by making a post office claim but you are not required to do this.  And I suspect the claim will be denied, but that is not your problem, it is his issue.

Was this a global shipping program purchase? I see nobody has bothered to ask that yet. The seller actually may NOT be responsible here. You don't need to bother with any insurance claims whether it was GSP sale or not though.

As has been already pointed out. You're covered by the eBay MBG even if it's shipping damage or anything else for that matter. Simply open a SNAD case in eBay in be done with it. You don't have to do anything else. The seller will either pay for return shipping and you'll get a refund or just you'll get a refund without having to return the camera. Let the seller deal with the insurance if there is any. If it was a GSP purchase, you still need to open a SNAD claim however with GSP, the seller may not be responsible (but that's not your problem).

Thank you all for the replies. I have now contaced the seller and he first started (again) that the camera was ok when shipped and it was due to shipping damage. I wrote him that he`s still responsible and if he didn`t agree to pay for return shipping i would have to contact Ebay. He now accepted the return because of the item was damaged. He could`t  send me a return label so i have just sent it at the local office and sending him a copy of the receipt of the return-shipping cost. I hope i will accept this and not start to argue again since the  now is camera already sent. I´ll give you an update later. Thanks again

He's not going to reimburse you for the return shipping.

Yes. File an Item Not as Described case and let Ebay handle it. Do everything by the book on this. Follow the instructions.

OP has already done that.

 

@mortehatlevi_0 You need to collect the return shipping money from the seller upfront. If he won't send the money through PayPal now, you can ask eBay to "step in".

Do NOT pay for postage without the seller paying you upfront, otherwise you're likely to be out that money. There is no way for eBay to enforce that after the fact. Have him Paypal the money to you, otherwise contact eBay for a label.

Does your return shipping have a tracking number viewable online that will show delivery back to your seller, and not that it only left your country and then disappeared?
