Question about returns.

Buyer receives item (a used CD). A few days later he opens a return, which gets auto approved. He wrote:

i received item but decided not to purchase and it was not opened and will be back in the mail Saturday june 1 st.

He refused the package and initiated a return to sender. It arrived back to me today.

The truth is he did open it and removed the internal packing before he resealed it.
He lied to ebay and possibly committed postal fraud buy opening before refusing.

Do I have any options other than to fully refund? I'd sure like to hit him with a restocking fee.

The buyer has been registered less than 2 months and has a FB score of 10. After he initiated the return,
i happened to check his feedback left and discovered he has not left a positive, but has left 5 negs!
The all pertain to not receiving the item and not getting a refund on a return.

Nope, you don't have a choice.  Just refund.  No restocking fee allowed.  If the CD is undamaged you must give a full return.  Missing packing material doesn't count as damage.  Buyer is not required to send it back unopened, and is not required to tell you the truth.  He is not required to be honest with the post office.

 

My guess - he made a copy of the CD before returning it.

Does your Return Details page say that the item was delivered back to you?

If you had free returns, you could have deducted up to fifty percent for a damaged return.

If you can show the buyer 'refused the package' for 'return to sender' then that voided the Ebay MGB. Therefore he shouldn't be covered by Ebay. Buyers must return the item back in the condition in which they received it, hold Ebay to their own policy when you speak to any CSR about this. Make sure to add this buyer to your BBL and take note of his information incase he would try buying again from a different account. I would also report him for abuse of EBay's MBG.

As for what YOU can do, file mail fraud and internet fraud charges against him. He clearly does this regularly and created that account for the sole purpose of scamming people. Take those report numbers and appeal the return case to Ebay. Add a 'RMA' number required for all returns and it will eliminate some of the automated return nonsense.

usps.com shows it delivered back to my PO box. tracking on ebay only shows it arriving back at my branch so far.
i'm sure i'll have to refund him shortly. and i will report him again.

I doubt that he was able to Open that Package in Front of a Mail Person when it was delivered because the mail person would then have marked it Received !! And he didn't get the item and keep it and then turn it back in to postal service saying he didn't want the item as Again it would have been Marked Received !! He Received a Marked Received item and Cannot just go in to a post office and say he doesn't want the item and to send it back to you Without Paying for the Return Shipping !! Your Problem makes no sense and No nothing can be done !!

It's possible. Basically the same thing happened to me several years ago with a VHS tape that was opened (and I'm sure the tape was copied), but the buyer sealed the packaging back up very carefully, marked refused on the package and put it back in the mail stream. It was returned to me.
