No option to create an eBay case eBay are also baffled by this

Hello people,

 

Ok this is a strange one maybe someone could shed some light on.

 

Ok so I live in The Netherlands but as I'm originally from the UK and I have had a UK eBay account since 2003 I still use it a lot. 

 

A couple of weeks ago I purchased an item on ebay.co.uk from a seller based in France. The item arrived but was not as described beyond belief so I contacted them to return it. I never received a reply so decided to ask eBay to step in as I know this is what to do. The problem is that I had no option for this other than a return item button. When I clicked on that it just stated that the seller opted to not accept returns. 

 

At this point it just advised me to open a PayPal case. When I clicked on that it defaulted me to ebay.nl and then prompted me to login to my PayPal account. I did that and under the transaction page for this purchase I only had the option to click on a link to the eBay resolution page. This just went in circles. 

 

At this point I decided to call eBay and spoke to someone that really had no clue. She said to me that I had purchased this on the Italian ebay page so there for was not elgiable to EMBG. This is bizarre as I am not in Italy nor would I use the ebay.it site for any reason. 

 

She then decided to put it down to the fact I was in The Netherlands. 

Again I challenged this because on the website I used (ebay.co.uk) which I am obviously not restricted to use, it states on the product listing that I am covered for buyer protection. France also has buyer protection. I can pay in Sterling GBP with my Dutch PayPal account and everything is rosey as it has been for the last 11 years that I've lived here. 

 

My arguement is this. If it is to do with the Dutch IP address why does ebay not default me to the .nl ebay on purchase. It knows my address info in there is Dutch registered as is my credit card info and PayPal info. 

I cannot find anything in the T&C's stating that I am not covered for buyer protection even though it is plastered all over this listing. 

 

This is not a one off because when I now look back through the last few purchases I made (2 from the US and 1 from Hong Kong) I also have no option to create an eBay case if I wanted to. 

Furthermore I also have no option in my PayPal account to create a PayPal dispute for these transactions either, it just advises me to go through the eBay resolution centre. 

 

After numerous calls PayPal helped me and sent me an email stating they are also baffled that I don't see this an will open a dispute manually for me which I have replied to. 

 

So, has anyone got any light to shed on this or experienced this before? 

 

I mean if I am not covered for buyer protection because I am based in the Netherlands shopping on ebay.co.uk then don't state that I am covered for it and allow people to buy on it with a non UK IP or non UK delivery address.
