Double checking that I am doing this correctly since ebay policies keep changing.
I won a hard drive listed as new that arrived not working. I sent the seller a message stating the issue, seller replied saying its new and shouldn't have an issue and asked about the OS I was using. I replied, gave the seller a few days and did not hear anyting back. Next I opened a return request for Doesn't work or defective with a simple comment of "Drive is powering off by itself preventing normal operation."
Three days later I get a reply on the return request. Seller states the item was not defective, he does not accept returns and blames my handling of the drive. Then goes on to say it has a 5 year warranty and I should talk to the manufacturor. Its actually a OEM drive with no warranty.
Anyways is the best route still to not reply (so I don't say something that hurts me) and escalate the case in a few days when it becomes an option?

@johnschuricht The only thing you could say that would possibly hurt it you, is that you altered the item somehow-took it apart, glued it, taped it, cleaned it etc. yes just ignore him and ask eBay to step in as soon as the time comes. You’ll win this.

Yes, go silent, then when the time is right, click Ask eBay to stab in it.
Your seller is lying.

The seller has told you that they don't care,not likely to change their mind were you to reply.
Simply escalate and ask ebay to step in.

So Ebay managed to forget about the case after I escalated it. The email said Ebay would make a decision within 48 hrs and this is day 3 so I called Ebay. Surprisingly after the seller listed the auction as no returns, failed to accept the return and responded to the return saying he doesn't accept returns Ebay sent me a label to ship it back to the seller. Now for another week of waiting on a return.
