Mysterious (and perhaps shady) shipping practice

I ordered a new item on eBay.  The seller provided a UPS tracking number.  Two days later I received the very same item that I had ordered but it came from Amazon via Amazon Prime.  The package from Amazon only had my name and address with no information about who sent it.  There was a note inside indicating it was a gift but no indication of who it was from.  I thought it might be the item I had ordered but the UPS tracking number indicated the item was still in transit.  Two days later the UPS tracking number indicated that UPS delivered the package to my address that very afternoon.  However, there was no package delivered.  I inquired with UPS about this and they said they had delivered a package and that I should check with my neighbors as sometimes a package will be left with a neighbor.  This was not the case.   UPS then suggested that I contact the seller about the issue.  The seller also suggested that I check with my neighbors.  I then asked the seller about the Amazon delivery.  The seller has not returned any communication since. 

 

My guess is that the seller took my order and then ordered the part from Amazon which was $10 cheaper than his price on eBay.  But his price included shipping.  So I have to conclude that this seller has a Amazon Prime account and orders much of what he sells from Amazon.  Since Prime members don't pay for shipping, if he orders enough from Amazon, and includes the cost of shipping in his price, that eventually cover the cost of Prime and the rest is profit.  I really have no problem with this except that when I inquired about this with UPS and the seller, no one would confirm the situation.  What I don't understand is that how could UPS issue a tracking number then not deliver anything but indicate delivery then just blow off an inquiry.

 

Has anyone else run into something like this?

As a personal rule I don't leave negative feedback.  I would try to work the situation out with the seller.  This situation doesn't rise to negative anyway even though the seller will not communicate.  I won't leave positive either because it wasn't a positive experience.  If I were to leave neutral I would have to explain why so I won't leave any feedback.  The situation was confusing and the seller chose to ignore my inquiry so I decided to relate the experience on the discussions board.  In all likelihood the seller knows that what he is doing is in violation of both eBay and Amazon policy and that's why he chose to ignore me.  I'm sure that will catch up to him.

Amazon tracking doesn't work for eBay so the seller managed to get a UPS tracking # for the same zip code.

You have the right to pull the contact information on the seller from ebay. Do it.

Use it to get in writing that the UPS tracking was sent to some place else than your address. Use this with eBay for the scam this user is doing on shipping.  As for the other Amazon item: who knows.

The shady tracking shows some thing way wrong with this seller.

However, listing an item on eBay and then purchasing the item from another retailer or marketplace that ships directly to your customer is not allowed on eBay. Did the seller post a Tracking Number to eBay?  If they did, is this the Tracking Number of the item you received?

 

What is the likelihood that the item you received from Amazon is a Gift from someone you know who knew you were looking to purchase the item?

 

Can you call Amazon and ask who sent it to you?

The seller did post a UPS tracking number to eBay.  It is not the tracking number of the item I received.  The item I received was delivered by Amazon Prime under a Amazon Prime tracking number.  My wife is the only person who knew I would be ordering this item.  I know she didn't order it from Amazon for me.

 

I have researched this sellers items for sale.  Most of the item images are a copy of the image of the item sold on Amazon.  In many cases the description is copied too.  I have also looked at some of the completed transactions via his feedback profile.  Most of these items are also sold on Amazon.  In all cases where I found duplicate items on Amazon this seller's price was $8 to $12 more expensive.  But he includes shipping and handling in his price.  We're talking about items in the $10 to $75 range.  So, if he has a Amazon Prime account he's banking $8 to $12 by just placing an order with Amazon.

 

I'm not saying that I was cheated.  I do not have a Amazon Prime account and if I ordered the item from Amazon it would have cost me about the same money with shipping charges added.  The issue I have is when I asked the seller to clarify the confusion over the bogus UPS delivery versus the Amazon Prime delivery he stopped responding to me.  That's why I opened this discussion.  I have since learned that if the seller is actually taking orders on eBay and filling them via his Amazon Prime account he is in violation of both eBay and Amazon policies.

Sure, I understand what you are saying.

 

My thought

Technically you have not received the item based on the UPS Tracking entered into eBay, correct?  I would think the seller would want to confirm that the package from Amazon is the one they actually arranged to be sent you.   If they can or will not confirm this then I do not know?

In the listing what was shown as the items location? Was the item shipped from that location or a different one?

If it was shipped from a different location you can return it to the "seller" on his dime.

Misrepresenting the items location is a valid reason for a Not As Described return.

In that section of the eBay MBG it states: The seller had misrepresented the item's location.

 

Covered

  • The buyer must request a return but may not be required to ship the item back to the seller.

I'm not saying that you want to get the item for free but this way the "seller" has to pay the return shipping.

Then you are free to buy the same item wherever you want.

Thank you for the info.  The item was shipped from many states away from the state where the item location was listed.  I will definitely look into this.

Um, wouldn't it be FRAUD to return the random 7 pound item which did not arrive under the UPS tracking number for the 1.2 pound actual item that went to Audrey?

OK then lets do it your way. OP files a INR with eBay since the UPS package never arrived.

 

OP keeps the 7 pound GIFT from Amazon and also gets a refund from the seller for the item that never arrived.

 

Obviously the 1.2 pound item that went to Audrey isn't the correct item so that is the sellers problem to work out.

 

Which one would you do?

Um, but the UPS tracking number actually shows Delivered.

So OP would lose the INR and won't get a refund, and feedback is blocked/removed if already left.

I have since concluded that the item I received via Amazon is not the same item that is described in the sellers ad.  Although similar it is of lesser quality and does not meet the stated specifications of the item the seller advertised.  I am still trying to get in touch with the seller to determine whether or not he actually sent me the Amazon item and to attempt to work out a resolution.
