So I recently purchased an item that was shipped to me internationally from a different country. The item arrived as "used" when the seller listed it as "brand new unused and unopened". Thus, I opened a return request and am currently having an issue with returning the item.. I purchased a 3ds console so it has a battery inside. I went to post off the item a few days ago and after screening the post office has realized that there is a battery inside and refuses to ship the item back to the seller. I have contacted the seller and asked them if it's ok with them if I remove the battery from the system and send it back as is. The seller hasn't responded and I have no idea what I should do. I've never had a problem with items I buy before so I don't know how I should handle this situation. Should I simply just mislabel the item and attempt to send it off via post oncemore?
Can anyone please give me some suggestions please? Much appreciated.

You mean a Nintendo DS?
Those batteries are fine.

Yeah. I shipped the nintendo 3ds system back to the seller because it arrived used. There is a battery inside, in my local city, shipping batteries is prohibited...
