I have a high dollar package I mailed out on 8/5 from VA and it was in FL the next day. Then on the 10th tracking updated it "arriving late but on its way" and that's what is still showing. I paid $55 to ship medium flat rate with insurance. I have been in touch with the buyer and he filed a missing mail request which turned up nothing. Then he got worried and knowing that it was insured, he filed the insurance claim with the post office. But then he realized he would only get the money back for the items and not his $200+ in state taxes so he requested a refund through ebay.
So, I have one more day to reply to his ebay request and refund all his money back to him but I now can't file the insurance claim with USPS because he has already filed it for himself. He would get his money back twice. (and possibly the package if it's ever found) I would get no money and no product back. I plan to call the insurance claims number tomm when they open but not sure if they can redirect the insurance money if it gets approved.

You can try to intercept the package and have it sent back to you.
Once you receive it back, then refund the buyer.

You CAN file the USPS insurance claim; either party can file, and USPS has a specific policy statement regarding dual claims. If both parties claim, then the SENDER will get the payout IF the recipient hasn't already received it. I recommend that you file immediately if possible. See sections 1.3 and 5.5:

I can try that but the missing package case was closed with no resolution. I need to refund him by tomm according to my message from ebay. Or else he can ask ebay to step in and I don't want it to escalate. I will try that link and see if if lets me intercept it even though its MIA. Then I need to figure out the insurance claim so I'm not out thousands of dollars. Thanks for the suggestion.

I tried to file the USPS claim last night but as soon as I put in the tracking number it came up in red and said there was already a claim filed. I filled it out anyway but after typing it all up it said there was an error because the claim had already been filed.

Yeah, I just tried again and it said 2 claims for one package is not permitted. I will try to call tomorrow.

What on earth cost $40 on top of the Medium Flat Rate price, that aught to get you overnight or second day guaranteed shipping.
$200 plus in taxes puts the item value in the pick up in person only range.

Is he mistaken what insurance pays? His web based invoice, what he paid on the invoice is the declared value. They will minus the insurance cost if insurance was purchased. However, why is the buyer trying to double dip? That's fraud. Insurance is for the SELLER not the buyer. Their insurance is eBay buyer protection. You have to reimburse the buyer whether ir not insurance pays. Seriously, look into him double dipping. He needs to drop the insurance claim or have fraud charges bought against him. eBay has no judicial power and they're not law enforcement but maybe their Safety & Trust dept should be notified. I'd be calling your state insurance commissioner or state attorney and see if they can assist.

Try to call the insurance claims number and let them know that you need to be the one filing the claim so you can properly refund the buyer here. Another thin I would do I’d ask for the insurance claim number identification whatever to show that the buyer has already filed the claim and submit this to the Ebay high values claims dept. GET on the phone with them as well. See if the USPS can send this to Ebay directly becuase they wont accept anything else.In general here you must be the one filing the claim so you can then refund the buyer promptly. What a messy situation.

I would also still do a package intercept. I read a thread on here where a seller got two USPS workers telling them the package was lost and then the package appeared and was delivered shortly after that. This is a completely crazy situation with USPS right now due to the Postmaster General changes which has caused terrible problems like this for merchants.

Yes, in hindsight I should have used Federal Express or something instead of Priority Mail but I never had a problem with them before. Since this happened, I have heard horror stories about Jax Florida USPS distribution center which is where it was last scanned. And I have heard from numerous people who are having problems with packages getting delivered.

I just talked to him about cancelling the insurance claim but I am not sure if that will look suspicious to USPS if he cancels and then I come back and file. I already called USPS insurance claim and they wouldn't give me the case number and said its not being processed yet because today I escalated the missing package search so I have to wait a few days now. He said he won't escalate the ebay refund and we will wait a couple days to see if the search turns up anything.
We just don't know how long he has to get his refund from ebay. He paid on Aug 5th. What is the refund deadline?

He can open an INR claim (Item Not Received) up to 30 days after the expected delivery date shown for the item on eBay. Of course right now he already has a claim open, but there is plenty of time to file one. Then you have 4 days or so to respond, before it can be escalated to eBay. Please note that if it goes through eBay decision to award the buyer the refund you have up to 30 days to appeal with proof of delivery. If you voluntarily refund the buyer through paypal there is no way to reverse this. You are relying on USPS being able to intercept the parcel, or the buyer to be honest enough to resend the money if he would get the item after you refunded through eBay.
