Do I need to accept this return?

Hey guys so I sold a brand new computer component sealed in box. I listed the item as non returnable as well as before shipping messaged the buyer stating that if the item was opened no returns would be accepted, and he messaged me back saying that he accepted the terms. He also already left me feedback stating the item was delivered in perfect condition.

However just today he messaged me saying that the item had stopped working and is looking to return the item to me.  Am I required to accept this return?  I delivered the item in perfect condition and as advertised in brand new condition and the return request was opened as item was not as described.  I offered to help him with the warranty process with the manufacturer so he could get a new working item however he declined.

Has anybody been in a situation like this and knows what I should do?  Thanks so much for your help.

Unfortunately, you do have to accept the return, only because the buyer knows the trick of calling it "Not as described" which trumps all. eBay will make you accept it no matter what stipulations you had set.

eBay will send them a return shipping label and bill it to you in your monthly fees.

Also, if you don't accept the return, ebay will let them keep the item plus bill you for the refund.

Ebay's money back guarantee covers all items and has nothing to do with your no return policy, which only refers to remorse returns.  So yes, you must follow the not as described return process.

Did the buyer actually open a return, or are they just messaging you?

If they are just messaging you, he MAY be trying to wheedle a post-sale discount from you. Tell him to return it. See what happens next. Let us know what he says.

If they actually opened a return, accept it and send the label.

The easier you are to offend the easier you are to control.

If it s brand new as you describe and a computer component, I am wondering if it is under warranty of any kind. Perhaps the buyer cold return to manufacturer for a replacement, or you could when you get it back.

Thousands and thousands of sellers have been in your situation.

If your transaction goes the same way as those, if you don't accept the return then you will most likely be forced to refund the buyer anyway ... AND get a damaging "case closed without seller resolution" defect.

How long has the buyer had the component?  I am of two minds; some items you need to install to determine if it is fit for purpose.  OTOH, he fundamentally changed the item by opening the factory sealed package, installing it (who knows if he did it right) and running it for an indeterminate time, again under who-knows-what conditions.  You might (a big might) be able to make a case for the buyer returning the item in altered condition and therefore not be able to provide a refund, either in part or full.  I hope you kept all communications through ebay messages; they will be a big part of your case.

It is not a "trick".  It is a reason for return.

Now if the buyer had changed their mind, and just did not want the item any more it is a "trick".  Well more specifically, rather than a "trick" it would be a outright  "lie".

Since the buyer filed an INAD, yes, you have to accept the return and pay return shipping, if you want the item back before refunding.

If you don't accept it, Ebay can refund the buyer from your account and let them keep the item.

If the buyer ships back their old broke item, after you refund them, file a police and mail theft report, then use those reports to appeal the case.

Have a great day.
