Can I speed up the refund process if i know for a fact that i got scammed?

I'm new to ebay and I tried buying from this guy who offered cheap international shipping, he had 99% user rating at the time of the purchase but oh well I got scammed. Checking his history he seems to have built up a reputation using cheap items and then used the phones for this exit scam. The item is set to arrive between January 29th and February 11th and after that I think that's when I can request a refund ? I'm asking if I can request it earlier so I can get a proper ebay experience and get a new phone earlier cause I kinda need one. Thanks in advance.

Wow, why would you buy from a seller with such terrible feedback? always check that first before you buy. If you dont receive your item just after the last estimated delivery date, file an item not received case. If you do get the item, and its not as described, file an item not as described case,you have thirty days.
