I sold a purse at auction. Buyer received on Oct 12th. My return policy was "buying is" and "no returns". On Oct 18th she emailed me and said there was a flaw I had not revealed and she wanted to return and get a refund. I agreed to let her return the item and typed my address on the email. I stated that she would pay return shipping. I sent her an email around Oct 26 stating I had not received the purse and did she have a tracking number. She did not respond. I sent another email Nov 1 asking again if she had shipped and what was the tracking number. This time she responded that she had been ill and would put in the mail Nov 1. I have not heard from her about a tracking number and do not have confidence that she mailed it on Nov 1. I could have sold this items several times already because I had a number of people watching it. How long should I wait before opening a case against her?

I hope you haven't already refunded her before getting the item back. There's no way that I know of to open a case against a buyer for not returning something.

There is no case you can open against her.
She either returns it or she doesn't.
Did you already issue the refund? If so, you are between a rock and a hard place. Never issue a refund before you get the item back.
If she didn't open a return request and you haven't issued a refund, let sleeping dogs lie.

There is no case to open and stop messaging them, you can wait them out if you just stay quiet.

I honestly can't figure out what your problem actually is. Just leave your buyer alone or you may not like the outcome at all. If you get it back, refund it. If you don't, why worry about it.
But if you keep bugging your buyer, they may just file a claim with Ebay. And even though you have a no return policy, Ebay will make you pay for return shipping on a damaged item.
I'm not sure why you have been pushing this buyer anyway. Would you mind explaining why?
