Hello -

I am a long time ebay buyer/seller with perfect feedback rating. I recently sold an item (sports jersey) that was shipped and received by the buyer. My listing clearly stated "returns not accepted" and the item was clearly described including size, condition and included numerous detailed pictures. The buyer never asked any questions other than making an offer that I accepted.

2 days after the item was delivered I received a return request message through Ebay stating the item "doesn't fit". The buyer acknowledged in his message "I know it says seller doesnt except returns, but its not doing me any good that I can wear it". He also acknowledged that the item was in
"pretty good shape". He never requested a refund and only stated "I have no choice but to return it".

I promtly declined the request and did not message the buyer. My listing shows "this return is closed". 3 days later, the item appeared on my doorstep. So now I have the item AND the buyer's money.

Just wondering what my best response is. Do nothing/see what happens? Message the buyer and request a prepaid shipping label so I can return the item? Contact Ebay and report a problem with the buyer? I'm not keen on refunding an item when the return policy was clearly abused. Thanks in advance for any input.

Did the buyer pay with PayPal or with a credit card?

I would discuss your situation with customer support, possibly someone on these boards may be forthcoming

with appropriate guidance.

Yes it does. He can open a not as described in PayPal if he doesn't get his money back. If he loses he can file a credit card charge back.
All he needs is the tracking number to prove you got it back.
Either refund him or return the item, you cannot in good conscience keep both.

The buyer paid to ship it back to you. So it actually costs the buyer money. You have the item back. Refund him.

Once you refund you will get your FVF back.

BTW, your "No Returns" policy does not trump the Ebay MBG.

Your best response is to message them and ask if they want their stuff back.

If they don't, BBL and move on to the next thing.

Buyer is hoping that you will use your discretion cut them some slack - and they have not abused the SNAD process. Seems fair to refund either in full or their payment less your fees and expenses.

As you now have the goods which are not abused and their cash, you would lose a Chargeback case if they decide to up the ante and file one.

You have a chance to close this out amicably before it takes a turn for the worst. Do that.

The best resolution to negative feedback is to see it coming around the corner and avoid putting the buyer in a position where that card seems like the best one to play.

Figure out the fees and deduct that and give him a refund. Deduct the shipping charge. And then re-take the photos and relist it. Make sure that you block the buyer. Make sure that the item is not defective or perhaps the size is wrong. See if you can verify that it is a true Medium or whatever the size is. make sure that the item is clean and does not smell like your buyer!

You can't keep the money and the item. That is wrong.

This is true however, the MBG only covers items that never arrive, are damaged or aren't as described. None of these apply. When a buyer returns an item after a return is declined, isn't that abusing the return policy?

Yes, I agree, keeping the item and the $$ would be wrong. I'm inclined to send the item back on my dime but am concerned about a disgruntled buyer then opening a case. Could he win after gaming the system like this??
