Broken Negative Feedback System

Shame this is my first post on eBay forums but here 'goes.

 

I purchased an item on October 20th from a supposedly reputable seller on eBay with zero negative feedback. The item was listed as brand new in both the description and condition. Much to my chagrin, upon receiving the item on October 25th, the item was in fact damaged, and pieces were missing. I immediately put in for a return, which the seller granted, with no explanation for the discrepancy between the listing and the item itself.  I left negative feedback as a result.

 

The deadline to ship the item out was November 1st, and I shipped the item out on October 30th (which I took video evidence of in case of the seller trying to be even more shady) and immediately put the tracking number into eBay. The item was listed as delivered on October 31st.  All good right? Wrong.

 

On November 2nd (yesterday) I received an email from eBay stating that the seller asked eBay to step in because the item was not delivered within the time frame given. Inexplicably, eBay granted the seller's request, and the case was closed, despite the tracking information for the return having been entered into eBay.

 

I was understandably furious, and immediately contacted eBay. Upon explaining to two of the customer service reps over the phone what happened, they immediately reversed the decision and refunded me the money. Additionally, they walked me through steps to report the account, which I did.

 

Come to find today, the negative feedback on the seller's account has disappeared. After contacting eBay customer service again in order to resolve the issue and reinstate the negative feedback, and escalating it to a manager, I was told that the system had deleted my feedback automatically when the case was decided initially (and incorrectly) in the sellers favor. I was told that there is nothing they can do, and that feedback is now permanently deleted.

 

I'm at a complete loss as to what to do from here, because at the time of this posting, my legitimate review of this unscrupulous individual who engaged in a fraudulent business practice has been deleted, with no way of future buyers being warned that this seller is in fact, listing items fraudulently. In fact, a quick search of this buyer's profile reveals that they are currently listing items similar to the broken one they sold me, while listing the condition as "New" and then stating "Used" in the description (which the seller did NOT do for my listing).

 

I'm not certain the level of engagement that eBay has with it's forum members, but this was my last resort for trying to get my negative feedback reinstated. For long time community members; was there anything I could have done differently?

 

If in fact eBay is unable to reinstate that negative feedback, larger questions about the feedback system itself are raised in my mind. Is this a well known loophole that shady sellers/buyers exploit?

Although I understand why you are upset, I don't think this is a loophole that sellers  take advantage of because its very unusual that the seller would win a case when the item was obviously shipped back to them.  I'm not sure what happened as normally once a label is printed out, the tracking number is already entered in the transaction. 

Unfortunately, as far as I know ebay has no way of reinstating feedback that they removed.   The system is just not set up like that.

The seller sent you a return label right away and then you still gave him a negative? Why? That to me is good customer service..

 

What more could this seller have done? Glad they got the negative removed tbh...

The damage done to the item was a plastic peg that was glued into it; in other words, the seller was completely aware of the item being damaged and yet proceeded to list it as brand new. 

 

Your definition of good customer service scares me. What more could the seller have done? Not fraudulently listed the item as brand new for starters and then disputed that the item was not shipped on time when in fact, the item was shipped and clearly tracked in eBay...

 You have an interesting view on good customer service.  According to the information that we have the seller sent out a product that was not as described but that should be ok because the seller sent a label for the return? Keep in  mind that ebay would have given the seller two options...refund in full now or send a return label.  It's unlikely the seller sent the label because he wanted to give 'good customer service' but more likely that he didn't want to refund without getting the item back. 

 

Perhaps the seller honestly didn't intend to send out a broken item, we don't know for sure...but allowing for a return doesn't negate the fact that their had to be a return in the first place. Buyers don't shop just so that they can return an item.  I do think that in a situation like this, had the seller given the buyer an explanation or apologized for the problem, the buyer might have felt differently about giving a negative.  Perhaps not, but I don't think that all is made well just because a seller is willing to take the item back and refund.  Buyers are entitled to state in feedback that they had a problem with the transaction.

Thanks pjcdn - I surmised as much. I'm just supremely disappointed that corporate red tape is the reason for my truthful and honest review being deleted; which may perhaps expose other potential buyers to the same scam.

 

I'm not intimately familiar with the rules of the forum; am I allowed to name the fraudulent seller in this thread?

No.  You cannot "name and shame" on these discussion boards.  However, with enough information, members can surmise who the seller is.

Got it; thanks for the clarification.

 

In that case I will say that the item in question was a Star Wars X-Wing Millennium Falcon Expansion Pack Fantasy Flight Miniatures Game. The seller currently has 248 reviews, and has been an eBay member since May 04, 2015.

 

I truly hope that no others fall afoul of this individual's fraudulent business practices.
