he got the correct package a month ago.... still hasn't sent back the oringinal. now his attitude is "you shouldn't have screwed up my order, ha ha, F U buddy"
this is ridiculous. $90 item. not the end of the world, but wow.... what can i do?????????

Sorry this happened to you, but there isn't anything you can do.
You might be able to get a refund on the unused return label, but sadly, you made a mistake, and you hit an uncooperative buyer, who has no obligation (other than a moral one, which he doesn't feel) to return your item to you.
Sometimes things just don't work out the way we would like.

Unfortunately you can now do nothing.
In hindsight you now see that not everyone is as honest as they should be:(
Should have been done as a return to preclude this from happening.

Don't know if this would help, but at this point isn't it considered a stolen item?
Could you file a report to his local police with a copy to him?

Technically, I don't see how this would be considered a stolen item, because the buyer received the item addressed to them. The seller made an honest mistake and sent the incorrect item to the buyer in question, who is apparently morally deficient and feels entitled.

No it's not stolen by any means. No the OP cannot and should not file a police report. Legally the buyer has done nothing wrong. Morally and ethically is another story.

That's not the situation here. The rule was put in place when companies were sending unordered merchandise then billing for it. Buyer ordered from the seller but got the wrong item. It's not unordered merchandise, it's incorrect merchandise.
The courts recognize that mistakes happen. Do you think if your local car dealer sold you a car but made a mistake and instead of 30,000 the contract said 10,000? Trust me, you ain't gonna get the car for 10 grand. Or better, that 30 grand car was to be delivered to you and they accidentally dropped off a new Corvette by mistake. Think you can keep it?
unfortunately the only remedy is court but for $90? So not worth it. The best way to handle these situations as pointed out above, is to tell them to return it and a new item or refund will be send upon its return. Do what the large retailers do.
At this point it's a write off.

And if your curious, the legal term is unjust enrichment due to a mistake. Google it up.
