he said "there was no box with the IFI Zen Can 3. It was just a plastic zip-loc bag inside of another plastic bag. " I said "was there a paper with the tracking number on it? You are not getting a penny from me. The post office does not work that way. I used to work at the post office, and we do not send items without a box. You are just trying to get me to give you money that you probably damaged yourself! I am going to contact eBay as to what happened." He said "I understand your position, but the item didn't come inside a box. It came in a Ziploc bag inside a soft plastic mailer with no padding and it was damaged. I have photo evidence and will be escalating this to eBay as an item not described. a partial refund would've been reasonable, but since you're unwilling to do that, i will let eBay step in. thank you. Also, if I just wanted your money wouldn't I just have kept the $700 item you sent me on accident? If you look at the photos of it on eBay, it clearly shows NO damage."
He said "according to eBay's policies I am not responsible for how the package was shipped or handled. that's between you and USPS. the item arrived damaged due to inadequate packaging and wasn't as described in the listing. I'm willing to keep the item since it works, but I just want a partial refund for the cosmetic damage. I'd prefer to resolve this with you, but I will open a case with eBay if we can't come to an agreement.

Aaaah. It does not work that way. You are responsible. You chose the USPS to deliver the package. The buyer paid for an item and should get what he paid for. This is between you and the USPS. If you do not settle this and let eBay steps in, you will not only lose your money, the buyer will get to keep the item.

Even if you paid for insurance, USPS doesn’t pay out on claims resulting from poor packaging. USPS may have done it but you’ll have to stand behind the problem or lose the entire payment.

If the box fell apart, it could be that USPS put it in a bag. There would be stickers with info placed on the bag about the damage that happened in transit.

Once, the post office delivered an entire package of mine in a plastic bag. A strong, chemically smelling liquid had leaked from another package and spilled all over it, so they just bagged it up and sent it on its way.

In some cases USPS does pay out insurance to the SHIPPER (meaning you). But that takes you and the buyer working together to get the case satisfied .
In this case, USPS may NOT pay out insurance.
Either way, you the seller must take care of the buyer first and foremost. The buyer is under no obligation to wait for settlement between you and USPS. The buyer and the seller are obligated under eBay rules. If the buyer files a INAD case, you must take care of that or eBay will as the buyer escalates the case, and you will lose both money AND the item if you fail to. Kicking and screaming about no returns or that you think the buyer is scamming you, makes no difference. The buyer will still get a FULL refund. If you at least want the item back to resell, you need to at least accept a return and provide a label.
It's likely in your best interest to work out a partial refund in this case.

There may be some communication issues here. Do you know if the buyer is talking about the shipping box or the product box being missing? You claimed the item was new open box which implies there is a product box.

We have come to a resolution that both accept. I am returning part of the price of the funds that I received. Since you told me about the USPS handling of packages, I came to realize that they do repackage some items sent. I never saw it and assumed he was incorrect in stating it was put in a zip-lock bag.

Probably the best decision you could make. Lots of new sellers would kick and scream about no refunds and screw around and the buyer would escalate the case, the seller would be forced to refund and lost the item. Letting eBay handle it is the worst thing any seller can do. There are never positive outcomes when eBay is making the decisions.
