eBay winter storm seller protection is a lie

Buyer left negative feedback for FOUR items that were packaged in the same box. USPS DELAYED THE ITEM BECAUSE OF THE WINTER STORM & EBAY REFUSES TO REMOVE NEGATIVE FEEDBACK DUE TO THIS DELAY, WHICH IS A DIRECT VIOLATION OF EBAYS SELLER PROTECTION POLICY.  I have requested the removal twice  on the phone with an eBay agent, and both were shocked eBay wouldn’t remove it. 
EBAY SELLER PROTECTION IS A JOKE 

Buyer also claims items were broken but could not provide proof. All the buyer sent was a photo of perfectly wrapped items.

I don't see any complaint whatsoever from the buyer about the delayed delivery.  I see that one of their purchases was for TWO heat packs, which would surely be needed for so many fertilized eggs to stay warm enough during deep winter transit .... but you included only one heat pack, which not only ripped them off for $7.99 for the second one, but also probably killed some of the chicks.  Jeez and total amount the amount of money they spent!!  

Why were you even continuing to sell at such a hazardous time?  Tons of sellers put their stores on vacation during the storms because they didn't want to risk their sales of trading cards and video games having late deliveries .... but you kept right on selling fertilized poultry eggs???

I suspect the buyer is now just waiting to see how many actually hatch, to decide how much of a credit card chargeback they're going to do.

I refunded the second heat pack. I have been shipping eggs for 15 years.  If two heat packs were used, the eggs would become too warm and begin to incubate in-transit. The embryos will then die upon delivery when the cool down.  The eggs are completely viable. I have shipped eggs to Alaska. Eggs can get cold…they just cannot freeze solid. I actually delayed shipping the eggs for their safety and informed the buyer, which he was fine with.  Because USPS delayed the delivery, the heat pack ran out and his eggs arrived cool…not frozen

Do you have a link to that?  I live in Mobile and have seen no such special protection for the south, nor see any reason for it (it hasn't even been unusually cold down here).   And even if you shipped up to one of the affected regions, note that it only says it will remove negative feedback for transactions which had an INR case. You haven't said your buyer opened any INR's for their orders, and their  feedback complaints are about your packing, not the delivery time, so they aren't remotely eligible for the protection.

Couple questions. 

1. what is the strongest chicken? How much weight can this breed pull

2. what is the fastest chicken? How fast can this chicken run a mile in?

3. Who makes the highest quality chicken tack like bridles and driving harnesses.

4. Do you think the chickens will be more efficient pulling a smaller wheel like a 16in or a larger one like a 36in. 

5. After I cross breed the strongest and the fastest chickens around how many chickens do I need to aim for to be able to pull a wagon around that weighs approximately 750 lbs with the load?  I think about 50 or 60 but I may be underestimating the birds.

First, let me say that truly you can get just about anything on eBay.

I had no idea that live eggs were even shipped mail order let alone on this platform.

 

Second, let me say that I am a complete novice on breeding poultry/livestock from live eggs.

What I know can fill a thimble and leave room for a spot of tea.

 

Thirdly, however, it appears to this lay person that in dealing with such live & potentially perishable product as eggs there are inherent risks & dangers.

 

One such risk and danger is the live product not making it from point A to point B for whatever reason.

There could be many.

None may be the seller's fault.

It would still be the responsibility of the seller. 

Nature of the product.

 

But what do I know?

Until this thread & didn't even know I could purchase this item on eBay.

 

Best of Luck for sales that are so wonderful, they cover the cost of any losses!

I'm just curious, do you cancel a heat pack order if someone doesn't also buy eggs? I'm pretty sure requiring a buyer to buy additional items isn't enforceable. Why are the heat packs not worked into the egg listings (and price)?

At this time, eBay does not require that a buyer prove their veracity, including for  damage in transit. A buyer usually will cooperate and send pics, (apparently you did receive some pics from this buyer too) but they don’t have to.

 

(Side note: i recall recently (may have been sometime in the last year or two)—ebay ask for photo evidence in feedback for damage. But no more.)

 

Nor does a buyer have to provide such evidence to back up a claim.

 

You are fortunate your unhappy buyer did not invoke the Money Back Guarantee.

 

She is pretty clearly upset— not about any transit delay due to weather—there is no mention of that .But specifically about the packaging issues, damage, and being shorted on goods purchased.


She claims in feedback that she bought two packages, and was surprised to receive only one, minus some of the contents she paid for, that you state you gave a refund on. It was this that seemingly set off her outrage.

 

Did you refund her before or after you combined the shipments and enclosed fewer warming blankets? Or did you wait until after she complained?
