There's a whole other thread about this, long story short, buyer with low feedback bought a tack set (headstall and breastcollar - one of the earlier listings of mine that in my enthusiasm I listed as brand new - i.e. never been on a horse. It had every appearance of being brand new, but like most tack, didn't have packaging or a tag, etc. My mistake, lesson learned, let's not rehashed all that. Already resolved in my other listings)
The buyer that won the auction left a note at check out questioning if the listing said free shipping, why was he/she now being charged shipping.... listing was not free shipping, no. where. I inquired twice before I got an answer, they basically said my bad, must have been another listing.
Buyer gets the tack set, three days after that sends a short: This has sweat stains, why did you say new?
Does not have sweat stains. Didn't argue, just told them it had every appearance of never having been on a horse, it was my mistake, return for refund.
Silence or a few days, then they were back, wanting to know why I listed it as new. *sigh* Buyer got the stock 'return for full refund' reponse from me again, but kept angling around for a nebulous and very unspecific 'something else'.
Return for refund was the only response I continued to give.
Buyer finally opened a standard return case, the note in it said: I don't want to get my money back, I want a different, but brand new set.
(I'm sure you do - pay 30.00 for an unused inexpensive set, then try to whinge and cry and get a 200.00 set just to go away. No I don't think so. Get lost. Return for Refund. Period. Then its a permablock.)
I replied with: I don't have any other sets for sale, I'm sorry.
I accepted the return within minutes, sent a shipping label.
They have until Dec 6 to accept, but since then, not a peep out of this joker.
What happens if they don't ship it back? Am I going to see eBay sweep in and give the buyer their money back even if they never ship it at all?

I've only ever had one SNAD case where the buyer refused to return after I issued a prepaid label. Waited the 5 business days required for him to get it in the mail. He didn't.
Called ebay and they closed the case in my favor.

You made a mistake and listed it as brand new and now are bent out of shape that buyer is not happy that he did not get what was described in the listing.
Sorry, but I am 100% on his side. You made the mistake and it is up to you to make it right by sending him what he thought he was getting, and that is a new item.

No, if you stated return for refund, then you do not give the refund until you have it back.
And by then it will have sweat stains because the buyer tried it on their horse and either they or the horse didn't like it.
Caveat - if they send back something other than what you sold them, you will still have to refund.

But yeah, if I get it back and she's gotten it all nasty gross on her own horse (the thought occurred to me) I can still it and resell it in my brick and mortar tack shop.

If there is no posted with tracking return, the case will close automatically in a month. The policy says the buyer has five days after starting the return to ship the item back with tracking, but calling to get the closed by c-s too soon after the five days expire may just get the time extended and another reminder sent to the buyer. YMMV.

You have a B&M tack shop and your excuse is that you know nothing about horses and did not know this item was used?

Not even a little bit. There are only sweat stains because the buyer says there are sweat stains. I haven't looked for the original listing but I bet there's nothing in the pictures to suggest there were any.
IF (and I mean a mighty big if) there were sweat stains and the item isn't therefore new, the seller is under no obligation to provide a new item. He is required to accept a SNAD return and refund upon receipt.
Imagine the pandemonium of requiring replacement instead of return/refund...

First, you don't refund until you have the item back. Second, you said they opened a "standard return case" but then go on to say you "sent a shipping label" which typically you would be required to with a SNAD claim (which this really is). So I'm going to assume it's a SNAD claim and not a standard return (in which your return policy would come in to play). If after 5 business days after the return has been approved there is no tracking, you can call eBay and ask them to close the case in your favor, however if you do nothing, the case will die off on it's own in 30 days. EBay has been known to send "reminders" to buyers if you call, but if you call within the first few days its no loss, its when people want to call on day 29 I don't recommend it.
BTW, things that are expensive to ship are a prime target for scammers looking to make a fast buck. You really need a plan for dealing with SNAD claims even though this is not a high scam category.

The item was NOT used and showed no signs of use. Did you not read that? Horse tack doesn't always come with nifty protective packaging and safety seals and tags. In fact, unless you buy from a big box retailer like Tractor Supply, it usually has none at all. Most retail BRAND NEW tack has scuffs and signs of being jostled around.
Tack wasn't used. However, the buyer claims it was. Buyer won a 30.00 item, now expects a $200 in exchange. Not happening for a lot of reasons.
Moving along.
No money will go back to this person until I have it in hand. All I wanted to know was what happens if the buyer vanishes and it is NOT returned... because this is a scammer.

I'll continue to keep a close eye on the tracking then. If its not in the mail by the end of the 6th, on the 7th I'll get with CS and try to get it closed.

Seller enthusiacically called the item new when even she admits it is not.
What part of that is hard to understand.
As far as being a sellet for 19 years I think that would be easy to comprehend because as both a buyer and a seller I can be fair when dealing with either one..
