VERO Restrictions

Trying to sell genuine items and eBay believes any company that is on there VERO list or not on the list. So we the sellers get restricted.... Of course you cant respond to eBay. Well they will loose my money for awhile. Very frustrating.

Although the wording can make it sound like it’s counterfeit, it also means, you don’t have permission to sell that item. You need permission from the VeRO. It is up to you to get that permission. 

eBay would love the revenue from these transactions, but they lost a court case when Tiffany sued them years ago. Legally, they are bound to remove offending listings.

There is nothing Ebay can do when it comes to VERO. You can contact the company directly but Ebay has nothing to do other than side with the company complaint of infringement.

When Congress passed the Digitial Millennium Copyright Act, it granted websites like eBay "safe harbor" protection from liability for the actions of its users. 

 

But in order to receive that protection, the website must agree to promptly remove any allegedly infringing material upon notification by the Intellectual Property (IP) rights holder. 

 

It is not eBay's job to assses the validity of the Notice Of Claimed Infringement (NOCI)  that they received. In fact if refuse to take the material down and get it wrong they lose their liability shield and are open to a lawsuit. 

 

You can respond to eBay by filing a counter-notice to the NOCI. But be warned, a counter-notice is essentially a challenge to the IP rights owner to file a lawsuit against you. That is something you should probably discuss with your attorney first.

What type product are you trying to sell?

What type infringement were your items taken down for?
