Three of my listings for a 77 year old phonograph record was removed because of “Counterfeit Items Policy”????? Bilt More Records was a company that started in the late 1940's and they did reissue older recordings from the 1920's and early 30's. RCA sued them and closed them down for reissuing titles that RCA had no interest at the time, but wanted to play ruff with Bilt-More Records thus closing them down. They did have a nice size catalog before closing their label down. Okay I get that, but I and other sellers have been selling these 78rpm records for decades, so now RCA wants to come after these 77 years old records, of recordings made 90 years ago! Somehow I don't think that a copyright violation would bring enough cash in to merit any legal action in a court! Any court would toss this one out! This is so dumb! As my three listings were removed dozens are still for sale on eBay? So whats going on here? Some other seller wanted my three down, so they could sell their copies? Who knows! So don't list anything that's 77 years old! You may get in trouble! RCA will come knocking on your door!

Do a search, find out who is selling same. It is one of them. For sure.
Researching who is selling these records would be a complete waste of time. It is extremely unlikely that the records in question would ever sell. Those records have a hard time selling when priced aggressively and the original poster doesn't price anything aggressively at all as far as I can see.
The original poster has something like 25,000 records listed and their store has a 17 year sell through rate, which I think might be the longest store sell through rate I have ever seen.

Number of listed items divided by number of sold items times 3 is sell through rate in months.
Your sell through rate is exactly 3 months, which is incredibly good.

Over the years I have sold many Bilt-More 78's – the interest has dropped off, because collectors want the first original release. Bilt-More records have good sound, and depending on the 78 copy Bilt-More used to make the master disc, some of them sound very close to an original. There are dozens of 78rpm re-issue labels from the 1940's most have a generic label, names such as “Hot Jazz Club” or whatever. I guess Bilt-More just got caught! If another member seller turned my listings in, because they wanted to kill the competition – that's a sad comment on America! I wouldn't put anything past anybody at this point! BTW the listing that have been taken down, eBay put them in my unsold list, and I can't
delete them????? Any thoughts? I have tried everything?????

They are afraid of what? Would RCA come after Discgo's? Superior Court would cost more to pursue than they could ever get out of a seller on Discog's or eBay? I think over the past 20 years I have sold a dozen Bilt-More 78's! About $9.99 to $19.99 TOPS! That's $239.00 dollars worth of sales on Bilt-More 78's! Would they go after $239 bucks? WOW! Times must be ruff at ole RCA!

So if I only steal a dollar from you, that makes it ok?
And tomorrow I do the same thing again, and the next day and the one after that...
And on and on, and after about a month one more person joins me and we each only take one dollar from you, two weeks after that there are three of us, and as this little scheme snowballs it's not long before you're losing $20 and then $50 and $100 a day from each person that only takes $1 from you... Of course a few of those got greedy and took a little more than a dollar but hey, you don't mind right?
Or if a dollar is too much we can start with 25 cents, you don't mind me stealing a quarter from you do you? I mean it's just a quarter, times aren't that hard for you now are they?
That's your logic in this process, I've seen it repeatedly throughout this thread and you're using it in your defense. Exactly how long should they wait before taking action, where do we draw the line, do we say any theft under $100 is all right? Way I see things these companies don't really care if it's 5 cents or $5,000, theft is theft and they're not tolerating it.
Not sure what part of this is wrong and you shouldn't be doing it isn't being understood here.

Exactly the same logic applies to all companies, including eBay, that "round up" their bills. They all think it's perfectly acceptable.

Sounds like the same logic that has increased snatch and grab thefts in Cali based on practically legalizing low value crime.
A whole whine thread when you already know you are in the wrong. But exceptions should be made for you because you are the little guy.

Not trying to steel anything from anybody! Let's look at this another way. All records, books, media etc
old and new have copyrights, for the most part. When you buy a new album, it understood it is for home use only, so in that case re-selling any item that has ownership can be taken down if the record companies wanted to! They make no money on resells here! All I did was post old records from the late 1940's of music that few people care about now! Some of the very old records even say on the back
side “can not be re-sold” okay so are all sellers of used items that are still under copyright in violation of that? BTW you can own land forever, but intellectual property rights expire after so many years?
Nothing in this world is fair! We're just trying to make a few bucks to pay bills and rent! I understand

Daaaamn straight! I get sick of looking at the same listings. Kind of like when I'm stuck behind someone in traffic -it's not that I'm really in a hurry; I just get sick of looking at the same car rump.
