What can I do? So I sold an oven on Ebay for $1927.00 and the freight company took longer than expected to deliver the item and while it was in transient the buyer opened a "item not received" case and eBay closed it and refunded his money even though the tracking number placed the item in transient as well. Long story short, the item was delivered 3 days after the case was closed because of the weekend and I'm now out the merchandise and $1927.00. The buyer now has zero incentive to pay for the item. A customer service rep from eBay even acknowledge that since the item was in transient and they should not have closed the case but my appeals of the decision have been denied 3 times now. What can I do?! I just want eBay to do the right thing and refund me but what chance would I have they would do this? Any help would be greatly appreciated.

I have no clue on what the outcome would be ha but the seller can try to press charges and see what the outcome would be. They would have to show the buyer intended on keeping property that was theirs. To me the buyer avoiding calls and not contacting especially if it’s been a significant amount of time shows they don’t intend on returning it. The buyer would have to know it wasnt their property to keep which could be based on what a reasonable person would think which is ultimately up to a court.

Of course no body but the criminal or civil courts would determine the outcome.
I see this situation more or less the way you do...so there is no conflicting conversation here.

You keep making your own assumptions and/or misrepresenting the facts. That is not what the OP said at all. They had tracking and it had been uploaded to Ebay, see post # 4 on this thread.

Obviously it was moving or the buyer would not have received it when they did. Honestly I don`t care what the story is....someone used a loophole to steal nearly $2k and ebay abetted them and because of the loophole ebay won`t do the right thing. Looks like I have some words after all.

I suspect many BBLs grew quite a bit throughout this thread's progress. I know mine did.
I also suspect that eBay has a few less sellers today. I am wrapping up my biz and leaving ASAP after reading brian's response.

It was a domestic shipment with a tracking number that could be verified. I had a customer service rep even tell me that whomever reviewed the case missed that the tracking number showed the item in transient

I can't tell you how many Account Managers/Supervisors I've spoken to from the Resolution department. All they do is write requests for appeals that seam to always get denied from the Corrections Department/Backroom Office. It was a supervisor from the Resolution Department that told me about how someone missed the tracking number showing the item in transient. She wrote a request for a manual refund and that was the second of the three denials.
In what post did Ebay say the exact opposite??
