What can I do? So I sold an oven on Ebay for $1927.00 and the freight company took longer than expected to deliver the item and while it was in transient the buyer opened a "item not received" case and eBay closed it and refunded his money even though the tracking number placed the item in transient as well. Long story short, the item was delivered 3 days after the case was closed because of the weekend and I'm now out the merchandise and $1927.00. The buyer now has zero incentive to pay for the item. A customer service rep from eBay even acknowledge that since the item was in transient and they should not have closed the case but my appeals of the decision have been denied 3 times now. What can I do?! I just want eBay to do the right thing and refund me but what chance would I have they would do this? Any help would be greatly appreciated.

I do not understand how they could have refunded the purchase while the item was still showing in transit. Do you have the tracking info and did you have them look that up to see it was in fact delivered?

Please do not tell me you shipped this expensive item without a tracking number that could be verified on USPS or any of the other carriers website. Was this an international shipment?

Yes, the tracking number was entered and they could see that it was delivered and signed to the correct address but since it was delivered after they closed the case, even though they saw it was in transient before they did so, they still refunded the buyer. To "assist me" they even sent the buyer an email letting him know they could see the item was delivered and that he needed to pay, but thats all they did to "try to help"

You should have called ebay before the last day of the expected time of arrival showed them tracking where item was in transit and requested the longest time of extension you could get.

It was a domestic shipment with a tracking number that could be verified. I had a customer service rep even tell me that whomever reviewed the case missed that the tracking number showed the item in transient

I had one buyer from hell....that got a huge 75% discount from me on the purchase, then a full refund from me, then found out he indeed got the item....and then he left me negative feedback to boot. Found out afterward, this guy's a mental case with some serious health issues. See, nobody gets off scotch-free that does evil....evil follows them and makes their life miserable. There's always going to be a percentage of people that will do evil to gain....but those people are misled...they are only hurting themselves. Forgive them...they suffer in their own ways many more hardships.

The funny thing is, is that I've contacted the buyer and every time I've called him he's pretended that he can't hear me, or he's pretended to be someone else and said that the buyer is "out of town". Its been ridiculous.

Send him an e-mail....be polite and ask him how he can sleep at night?.....it's the ONLY thing that motivates people on the edge of evil to reign themselves in to do the right thing. If he doesn't respond to polite and the question....then yes, it's over....but he is the one hurting himself. Let go and forgive him....know that justice is divine. You will be compensated for accepting the loss later down the road....Trust God on that one.

Are you appealing this case from a computer generated bot system or are you on the phone with eBay speaking with someone? Particularly about how the refund occurred as you said before the reps seen it was still in transit?

Another question would be how long did you let the first case stay open without opening your own dispute. If you let that case go on without a response from you over a period of time it was automatically decided in the buyers favor. Once that happens it is difficult to reverse because they think you ignored the case. That’s when you could have asked for an extension on the delivery.

I can't tell you how many Account Managers/Supervisors I've spoken to from the Resolution department. All they do is write requests for appeals that seam to always get denied from the Corrections Department/Backroom Office. It was a supervisor from the Resolution Department that told me about how someone missed the tracking number showing the item in transient. She wrote a request for a manual refund and that was the second of the three denials.

Looks like once something like this happens it becomes impossible for you or Ebay to collect back the money from the buyer. It is truly the buyers honesty that should come to play here. Unfortunately that’s not happening here with this buyer. So sorry and I wish you well.

If the buyer signed for receipt, I'd threaten him with contacting the sheriff in his county (or something) and request they pick up the item.
