Settle an argument for me

I bought a Microsoft Surface Book. The pictures of it show that is in good condition, and shows the unit POWERED on.

 

However, once I receive the unit, not only is the battery completely dead, but I come to realize that no ac adpater is included with it.

 

I contacted the seller and they said "the listings states no accessories". I did go back and see there was one small line in the mid section of the listing that says "Accessornies: none". 

 

I guess it is my fault for assuming that the charger would come with it, but is that really an "acessory"? I don't think it's an acessory at all, in fact, I would say it is a NECESSITY since you cannot use the thing after the battery dies...

 

To me it would be like a used car dealership selling you a car with an empty gas tank and telling you gasoline is an "accessory" and absolutely none is included...

Trying split hairs about what is a "necessity" and what is an "accessory" is failing to take responsibility. 

 

BTW, the Microsoft website itself calls the power supply an "accessory" :

... I don't see any mention of the power supply (either way) in the eBay Catalog, nor in the seller's listing.  However if you look at the pictures, the last picture shows the printed box for the unit (not sure this is exactly the same unit OP bought), and under "Includes" it mentions the power supply.  That's a box printed by Microsoft.

All Notebooks Laptops when sold new come with the chargers. There is no arument there. However, Did you get a good price as compared with a new one. Chargers are not that expensive. Many Batter establishment carry batteries and chargers for all kinds of Computers. You can probalby get one here on ebay cheap. If you decide to do that make sure it is OEM for your particular notebook. OEM (original Type Charger).Since you missed the fine print you can get a refund from the seller(remorse) or get a Charger.

That is not the same thing. At least not based on what you described in the listing. I highly doubt the listing stated "no accessories because absolutely none are needed"... But that is only one point.

 

When it comes to a used car, there is no "standard" amount of gas that it must come with when sold. I mean, do you expect a full tank? A half a tank? One gallon just to get you to the nearest gas station? Regardless of what amount you get it with, it was simply done as a courtesy by the dealer.

 

The other part in your original post that works against your claim, is the part where you yourself have already accepted responsibility for "assuming that the charger would come with it". This implies knowledge of a possibility that it did not come with one. 

 

Just an FYI, I am posting as someone who has in fact bought a laptop off of eBay, and before bidding on it, I messaged the seller to ask "besides the laptop itself, what else comes with purchase". Her reply was "battery is built in an is included, but that is all I have for it". So when I won the bid, I went online and ordered an AC adapter which arrived a couple of days after the laptop. 

 

Lastly, the only thing that could work in your favor is if the seller had posted a picture of the laptop showing any of these additional items that you would consider essential, but ones that you did not receive.

All cell phone and all tablets that are sold new do come with an AC Adapter and a sync/charge cord, most even come with earbuds (headphones). And yet look through listings of either and you will find that most are sold without. So it is not an "absolute must"...

How would it qualify as a SNAD issue if there was no "Description" or even mention of an AC adapter/battery charger? 

 

In other words, how could the buyer claim it as being "Significantly Not As Described" when in fact there was no description of an AC adapter/charger given in the listing?

 

The fact that a picture showed the unit as being "on" is not validation that it must come with an AC adapter/battery charger... I mean, if the picture showed an image of a Microsoft Excel spreadsheet, do you assume it comes with Microsoft Excel, or do you assume that was done for demonstration purposes?

Not only am I with you, I will add to what you said by suggesting that if you are unsure about one thing or another, ask for clarification. "Communication" is a key element to everyone's satisfaction.

 

"Used items" are sold "as is", and "as is" can be interpreted as being "What You See Is What You Get"...  If you don't see it, you don't get it!
