Selling prohibited used perfumes

I'm pretty sure that used cosmetics are a no-no here. This seller is constantly listing VERY used perfumes and cosmetics and has been for awhile and has even gotten a negative because of it. Not sure how they are able to carry on.

I'm pretty sure they "get away with it" because it is not a rule violation to sell used perfumes and cosmetics in the Collectibles category.

With 1.5 billion listings on any given day, eBay policy enforcement has never been comprehensive, timely, or accurate.

 

That aside ...

 

eBay policy does not state that every listing that violates policy will be taken down: 

 

"eBay may take action consistent with applicable laws and the eBay User Agreement, and may even be legally required to do so. Such actions may include, as an example only: Removing the listing or other content, issuing a warning, restricting activity or account suspension."

It's all about the category choice. While used perfumes/colognes can't be sold in the health & beauty category they can be sold as a collectible. The perfume attached to the item number you posted is correctly listed as a collectible as was 4 similar listings I looked at from the seller. I did find 1 incorrectly listed in health & beauty.

They only have a few listed in the right category, the rest are not.

I believe you have to get special permission from USPS to send through mail because of being flammable. Or at least that is what the poster says at the USPS.

@slyders_finds Sellers are allowed to send limited quantities with Ground Advantage. A seller can declare the applicable hazardous material(s) when printing their labels and it will print as an H class. You have to hand these to the postal clerk (no dropping in bins) and they will print an additional label to highlight the ground shipment status.
