Seller request for refund

I listed a faux bag and it was sold.  The sale closed on even of Dec 23 I went out of town that day for the holidays and returned Jan 2. 

Buyer says the item isn't as described.

I fully disclosed all details indicating faux leather, and plastic straps. 

i do not agree with the buyer request and do not want to refund the $.

 

Where can I get in touch with someone on ebay to help with this.  All I keep getting is automated responses.  Frustrating to say the least.

eBay will not help you.  When a buyer claims that an item is not as described, eBay almost always sides with the buyer rather than getting in the middle of the dispute.  If your buyer does not speak French, they might not realize that "faux"  means fake. 

 

The date of the transaction is not as significant as the date when the buyer filed the claim if any.

Best to just accept the return. If you try to fight it, you will likely lose anyway.  Here the buyer is always right.

 

Issue the paid return label.  There still is the chance they will never get around to sending it back.  That happens a lot with returns.

 

Words like " faux "  should be replaced by fake or not real.  Not saying it would have helped in this case.

I'm sorry, but you can't list or sell a counterfeit Louis Vuitton bag on eBay (or anywhere else, for that matter). It's against the law to sell a counterfeit, even if you don't use the brand name. The LV logo is clearly visible on the bag.

 

Your buyer is right. Whether you called it faux leather or not, it's still a fake Louis Vuitton.

 

Accept the return, send the refund, and hope that you don't get a defect for selling a counterfeit.

It clearly is a fake and no disclaimer will keep it from being a trademark violation.

 

Nothing you could put in the listing could make it comply with Ebay policy or US law. Certainly not the AI **bleep** description.

 

Apologize. Authorize the return, provide the prepaid label. Refund when received or Ebay will refund for you.

I would issue a full refund and hope they don’t report you.  I wouldn’t pay to have it shipped back because it should be destroyed.  The last thing you want to do is bring it to eBay’s attention.

You can contact CS and tell them you sold a counterfeit bag and the buyer wants to return it and I'm sure they'll be willing to help.

Do not attempt to stand your ground with eBay and call attention to your having violated one of the more serious rules here. You could be in danger of losing your selling privileges by listing a fake Louis Vuitton bag—counterfeit goods are not allowed to be sold on eBay, and worse, doing so is illegal to boot.


By the way, where in the listing does it state that this bag is a fake? You mention faux leather only. And not identifying the brand name is not the same as stating the bag is faux.

 

Even without the brand name appearing in writing, the monogram design is instantly recognizable as being LV. The listing is therefore misleading even if fakes were allowed by the platform.

A final note: Bone up on the terms of eBay’s Money Back Guarantee policy. Sellers who refuse to honor refunds on such claims open themselves to stiff penalties that can downgrade one’s eBay standing.

EBAY 30-Day Money Back Guarantee (supersedes "no returns policy") and allows customer to claim "not as described, counterfeit, defective" (you will be forced to refund purchase price + shipping BOTH ways.   Customers are NOT required to prove their claim.  EBAY always rules in  favor of the customer.

 

If you refuse to accept "return" (EBAY will punish you by giving customer a "full refund" and allowing them to keep your item).   Also you will get a "defect" against your account for not following the rules.

I wouldn't even authorize the return. Paying return shipping on a fake that you can't resell is throwing good money after bad. 

 

Apologize, issue a refund and let the buyer destroy and dispose of it.

Consider yourself lucky!
Its a counterfeit Louis Vuitton that you obviously knew was counterfeit because you never used the brand name. That is a slick way to avoid the bots, I assume that the buyer bought it on the 1 in a million chance it was real, you should be very thankful that they just said not as described.

^^^ I heard that. And I'd empathize except that I loathe  counterfeit items. Save yourself additional loss and frustration by refunding without ever having to see this bootleg again... let alone talk (to eBay) about it.

The title states nothing about a 'faux'...so if I bought that using my iPhone eBay APP I wouldn't see that and think it's real. Yea, everyone here saying this and that. We all sellers make mistakes sometimes. It was a mistake.

Shame on a buyer purchasing it and thinking it is the real thing...hoping for a big bargain of such.

And then returning it seeing it is a fake.

Once a buyer opens a INAD you pretty much have 2 choices.

1. Refund after return
2. Refund without return

This is a posting/buying ID.

It was a mistake on the sellers side for selling fake junk and getting caught.

The listing has been removed now.
