I sold a 35mm "Jurassic Park" feature to someone in Toronto for $2001. Due to weight, I packed in 2 boxes. A week or so later box 1 was delivered per tracking - the buyer said he received it. Box 2 was delivered, per tracking, the following day. The buyer filed a complaint to eBay that he never received the 2nd box (contained the 2nd half of the feature). We wrote back and forth to one another, checked both our Post Offices but no 2nd box. Since tracking said both boxes were delivered, eBay sided with me and closed the case. Days later, the buyer opened a RETURN case. I said fine, return the item (the first half of the feature he received) and we will decide how much we owe you. No response from the buyer. EBay kept the case opened for 4 days until they came up with a decision. I wrote to Roger maybe the 5th day about sending me his PP email address so I can send him some shipping money. No response from Roger, 24 hours later they sided with the buyer who now GETS TO KEEP MY FILM AND MY $2001! I repealed and they shot me down over and over, saying "We didn't hear from you in the 4 day period so we decided to give the buyer a full refund with shipping and he gets to keep my film". As of now I'm gathering all the information for my lawyer; what they did is bull**bleep** and illegal. I've never been scammed like this in my entire life!

After 10 years I quit selling on Ebay over Managed Payments, this confirms my decision! So very sorry to you for this unethical behavior!

Sounds like to me BOTH parcels were delivered.

Ebay doesn't have the capabilities to send an international return label, in fact there is no way to print a return label on ebay for Canada even if both buyer and seller are in Canada. That's why when it comes to international returns and the seller hasn't found a way to send a label or the money for it, ebay just refunds.
I suspect that if Paypal was the payment processor, it still would have been the same result.

If true the Op needs to file fraud and theft with law enforcement:
No other choice due to they are out money and goods.
As for ebays seller protection even if they had of followed what they could have done: it would most likly failed.
Seems such with Not as described will lose. No way for ebay or even a cc to say other wise... No way to prove it was as described. This is that fail for all sellers on ebay.
Use to be for high dollar amounts escrow could be used. yet that became a mess also....Fake escrow sites and scams still went on.
So back to rule #1:
If you can not afford to lose item, and money paid for it including shipping: do not list it.
Seller be aware....

It's OK to lose an INAD case and even have eBay OK a return in many cases. It's not OK to refund a buyer without the return of the merchandise first/full stop. If the seller decides they want to refund payment without the items return that's the sellers choice. In some cases because of the value of the item, the cost of shipping or whatever, they seller might waive the actual return of the merchandise.
For eBay to allow a buyer to get a refund and keep a $2000 item is nonsensical and creates a marketplace for fraudsters.

If the last case was filed after the MBG expired, Ebay wouldn't get involved.

1.Tracking indicated delivery of both boxes
2. Buyer alleges that only one box was delivered, however the official record says differently
3. Could there have been a carrier misdelivery, or porch pirate ?
4. Buyer cannot determine that the contents of the box that buyer claims never having received, was not as described
5. Never having received the box, would make it impossible to inspect the contents & impossible for buyer to return it to seller.

First Sorry to hear about your issue:
I only use Global Shipping Services Now and never a problem / eBay does great with that
I also - in the states make people sign for high end items [ FedEx will do that on high end items/ they will hold package till it is signed for } You might want to start doing this
I stopped 98% of selling my high end NASA items on line, I do have a couple ticket items but people will need to sign for it and I fully insure everything - Hence that ends all problems and for my business - restorations - my clients are to send their clocks and watches and trains Priority with sig required Never once did one come up missing
Lastly I just bought a train set and what I do is go into Postal Services tracking - put my phone number in and I get text messages - it finally happened a new postal worker did scan my item in when I went to the box - she left my package in the large key drop box but forgot to leave the key in my small box - point - I would have filed with the postal service and I would have asked the buyer what was his delivery set up, our area has lock boxes that they deliver to - point again I was tracking the package and I checked the boxes with keys still in them - and there it was my new used train set - if I lived in a bad area it would of been gone
You can file with postal service and under filing you can check box that it might have been stolen - they will investigate

EBay previously ruled in favor of the seller & closed the INR case.
Buyer then opens a return but a simple review of the initial underlying eBay case already reveals that buyer has openly admitted unable to return to their seller that which buyer claims not to be in their care & custody.
Seller would appear entitled to a full return, the contents of both boxes ,for buyer to prevail

Boy that is terrible advice.
Seller has tracking showing both items delivered, which is why they won the INR case.
The whole second case should have been thrown out, if it even happened. The timeline seems to be months later well past the deadline for opening any eBay case.

OP should go to eBay on Facebook or Twitter and talk to them there. They may be able to get some kind of results. Going to need a precise timeline with dates to show what happened though.
